Comments:
An unannounced complaint investigation was initiated on-site on October 24, 2023 and concluded remotely on November 21, 2023. The department received a complaint on October 10, 2023 regarding allegations in the area of programs. The director was available during the investigation. There were 25 children in care, ranging in ages from 8 months to 12 years, with 6 staff supervising. Interviews were conducted and records were reviewed.

The evidence gathered during the investigation supported the allegation of non-compliance with standards or law and violations were issued. Any violations not related to the complaint but identified during the course of the investigation can be found on the violation notice.

Please complete the ?plan of correction? and ?date to be corrected? for each violation cited on the violation notice and return it to me within 5 business days from today. Please specify how the deficient practice will be or has been corrected. Your plan of correction should contain: 1) steps to correct the noncompliance with the standard(s), 2) measures to prevent the noncompliance from occurring again; and 3) person(s) responsible for implementing each step and/or monitoring any preventative measures. Description: Based on staff interview, the center failed to inform the department's representative as soon as practicable, but not to exceed two business days, of any injury to a child that occurs while the child is under the supervision of the center and requires outside medical attention.
Evidence: 1. The department received a complaint report on October 10, 2023, regarding child #1 receiving outside medical care on October 06, 2023.
2. As of October 24, 2023, the center had not informed the department of the incident.
3. Staff #1 confirmed that child #1 did receive medical attention for the injury that occurred while the child was under the supervision of the center and the center did not contact the department regarding the incident with child #1.

Description: Complaint Related
Based on interviews and review of medical records, the center failed to ensure that when staff are supervising children, they shall always ensure their care, protection, and guidance.
Evidence: 1. An interview revealed that on 10/06/2023, child #1 was running at the center and hit their head on a table. Shortly thereafter, child #1 began throwing up. The center contacted the parent to report that the child was throwing up and failed to report that the child had hit their head. Child #1 became lethargic shortly after being picked up from the center and was taken for medical care.
2. Staff #1 stated that the incident occurred at approximately 10:30am, child #1 began throwing up at approximately 11am, the parent was notified only of the child throwing up, and the parent picked up child #1 at approximately 12pm.
3. The visit summary record for child #1 contained documentation that child #1 was diagnosed with a concussion at 2:20pm on 10/06/2023.

Description: Based on a review of records, the center failed to ensure that written records of children's serious and minor injuries contained all the required information.
Evidence: 1. The incident report for child #1 contained documentation of only one staff signature.
2. The incident report for child #1 did not contain documentation of any future action to prevent recurrence of the injury.
