Comments:
An unannounced investigation was conducted on November 28, 2023 regarding a self-reported incident that occurred on November 20, 2023. This visit was conducted between 10:15am and 11:30am. Interviews were conducted and observations were made. After carefully interviewing all involved parties, and reviewing records, the information gathered determined non-compliance with applicable standards or law and violations were documented on the violation notice issued to the program. Violations:
Standard #: 8VAC20-780-560-P
Description: Based on record review and interviews, a child with a diagnosed food allergy was served food identified in the written care plan.
Evidence:
1. Child #1 has an allergy to cashews and pistachios and was given dried cranberries on 11/20/23 at approximately 10:30am. The label on the package states " the product is packed on equipment that also packages products that contain milk, soy, and tree nuts."
2. The record for Child #1 has documentation from a physician and the parent that the child is allergic to cashews and pistachios.
3. The allergy list with the child's allergy to cashews and pistachios was posted in the classroom.
4. Staff #1 stated she was aware of the child's allergy to cashews and pistachios but she did not review the label of the dried cranberries prior to giving to Child #1.
5. Staff #1 stated during lunchtime (approximately 12:15pm) Child #1 began to eat his lunch (brought from home) when he laid his head down, started crying and said his mouth hurt. His mouth looked a little red near his left corner and he was rubbing his eyes. She encouraged him to drink some water and told him he could lay down if he did not feel well. Staff #1 radioed the office to ask Staff #2 to come give a consult on whether the child could have an illness or a reaction.
6. Staff #2 stated she observed Child #1 laying on the pillow and child complained his mouth hurt. Child did not appear to be in any stress but she decided to call the Child's mom to pick him up since child did not feel well. The child's Dad picked him up around 12:45pm.
7. The Parent of Child #1 stated upon arrival to school, his son was showing a mild reaction on his face. There was some swelling above his son's mouth and below the eyes. The parent gave Child #1 Benadryl and took him to the ER where he was observed for a couple of hours.
8. Staff #1 called the Mom at 2pm to check on the child, and parent said they had given him Benadryl and he was currently in the ER.
9. Staff #2 spoke to the Child's Mom at 4:00pm and parent stated child was cleared to go home. Child returned to preschool the following day.

Plan of Correction: The teacher and director met with the parents to discussed the best plan going forward. The child's parents will review all ingredients for any class celebrations, child will eat only food that is brought from home and parents will provide update from child's allergist. Teachers will review all ingredients and packaging of food brought into the classroom. Teachers will be retrained in regards to allergies, sensitives and intolerances.
