Technical Assistance:
The following was discussed with the owner/director:

-When using containers for children, it is important to read the manufacturer age requirements for each piece of equipment.
Standard 410: "Enclosure in a small confined space or any space that the child cannot freely exit himself; however, this does not apply to the use of equipment such as cribs, play yards, high chairs, and safety gates when used with children preschool age or younger for their intended purpose."

- When accepting a child into care that requires accommodations, It is recommended, an IEP or IFSP is requested to ensure the center can best care for the child and the other children in the group care setting. If there is not one, it is recommended an accommodation plan is developed with the center and the parent.

Comments:
A monitoring inspection was conducted on11/27/2023. There were 28 children present and 6 staff. A tour of the facility was conducted, in addition to a record review and interviews with staff. The Inspector reviewed a sample of children?s and staff records, along with any requested program records submitted by the facility to determine if required documentation was complete. Information gathered during the inspection determined non-compliance(s) with applicable standards or law and violations were documented on the violation notice issued to the program.

Violations:
Standard #: 8VAC20-780-330-B
Description: Based on observation the center did not ensure where playground equipment is provided, resilient surfacing shall comply with minimum safety standards when tested in
accordance with the procedures described in the American Society for Testing and Materials
standard F1292-99.

Evidence:
On the playground there was no resilient surfacing under 3 pieces of playground
equipment with moving parts or climbing apparatus in the fall zones.

Plan of Correction: The owner had contacted the manufacturer to have the 3 pieces of equipment removed and for a refund. The company is out-of-the-area and has not come to remove them yet. Until this matter is resolved, caution tape will be placed around the pieces of equipment to deter children from playing on them.
