Comments:
An unannounced non-mandated monitoring inspection, in response to a self-reported incident in programs, was conducted on-site October 4, 2023 and concluded remotely on December 5, 2023. The inspector reviewed compliance in the areas of administration, physical plant, staffing and supervision, and programming. Video footage was reviewed and interviews were conducted.

Information gathered during the inspection determined non-compliance with applicable standards or law and violations were documented on the violation notice issued to the program.

Please complete the ?plan of correction? and ?date to be corrected? for each violation cited on the violation notice and return it to me within 5 business days from today. Please specify how the deficient practice will be or has been corrected. Your plan of correction should contain: 1) steps to correct the noncompliance with the standard(s), 2) measures to prevent the noncompliance from occurring again; and 3) person(s) responsible for implementing each step and/or monitoring any preventative measures. Please do not use staff names; list staff by positions only.

Violations:
Standard #: 8VAC20-780-410-1
Description: Based on a review of video footage, the center failed to ensure that roughly handling a child was forbidden.
Evidence: On October 4, 2023, the inspector and child protective services investigator reviewed the school?s video footage of an incident that occurred on September 15, 2023. Staff #1 and child #1 were walking towards one another. The child grabbed a bag of M&M?s in the staff?s hand. The staff then grabbed child #1 and quickly turned the child around, pulled the child back into the staff?s chest, and then walked forward knocking the child to the ground. Staff #1 then turned and walked away, leaving child #1 on the floor.

Plan of Correction: Steps to correct the non-compliance with the standards.
a. Program Policies, training and monitoring systems will continue to support the enforcement of "No physical" contact with a child. It will also be emphasized that this includes horseplay, roughly handling, etc. This training was reinforced with all current staff on 9/18/23 and 9/19/23 as well as this being continued as orientation and training with new hires.
b. Personnel Action Taken with:Staff #1: Employee was on Administrative leave until the end of the investigations. Now they are complete, she has since resigned.

1. Measures to prevent the non-compliance from happening again:
To prevent this from happening again, Program will reinforce again by providing staff a training on Forbidden Actions using this incident as an example. This will take place on 3 levels:
A. Child Care Aide
B. Program Leader (Team Leader)
C. Management level
Providing at these levels will reinforce the obligation to follow all rules and will make everyone aware of the layers of oversight, prevention, supervision and monitoring that are in place. This will be complete by December 15, 2023

2. Persons responsible to for implementing each step and/or monitoring any preventive measures:
Program Director and Program Manager are responsible to make sure this takes place.
