Comments:
An investigation was conducted in response to a self-reported incident that was received December 1, 2023 regarding allegations of a staff person roughly handled children.

The Center's video recordings and staff records were reviewed, staff interviews were conducted, and the center's policies and procedures were reviewed in response to the allegations.

The preponderance of the evidence gathered during the investigation supports the allegation. Repeat violations were found and are identified within this report.

Please complete the 'plan of correction" and 'date to be corrected" for each violation cited on the violation notice and return it to the department within 5business days from receipt. Please specify how the deficient practice will be or has been corrected. Please do not use staff names; list staff by positions only.

Any plans of correction not received within 5 business days will result in the plans not appearing on the Violation Notice and public website.

Violations:
Standard #: 8VAC20-780-400-B
Description: Repeat Violation

Based on video observation, behavioral guidance was not constructive in nature, age and stage appropriate, and intended to redirect children to appropriate behaviors.

Evidence:
1. On 11/30/2023, at approximately 11:19am, Staff #1 is observed sitting in a chair in the middle of the classroom while Child #1 is at a table. Staff #1 is observed saying something to Child #1. Staff #1 gets out of the chair and approaches Child #1 and strikes them on the forehead. Staff #1 grabs Child #1 under the left and right elbow and puts Child #1 roughly into a chair at the table.
2. On 11/30/2023, at approximately 11:20am, Staff #1 is observed grabbing Child #2 under the left and right elbows and roughly putting them into a chair at the table.

Plan of Correction: On 12/15/2023, a meeting with Childtime-Huntington staff was conducted to discuss policies and procedures, the role of being a mandated reporter, positive guidance, behavioral guidance, and challenging behaviors.

Standard #: 8VAC20-780-410-1
Description: Based on video observation, staff used the forbidden action of striking and rough handling children in care.
Evidence:
Video recordings of the Toddler classroom on 11/30/2023 captured Staff #1 striking and roughly handling children.

1. At approximately 11:19am, Staff #1 was observed striking Child #1(23 months) on the forehead. Staff #1 grabs Child #1 under the left and right elbows and roughly places here in a chair.
2. At approximately 11:20am, Staff #2 grabs Child #2 (20 months) by the left and right elbows and placed them roughly into a chair.

Plan of Correction: Staff Meeting with Childtime-Huntington employees to discuss the termination of Staff #1, inappropriate handling of children. Discussion of termination with Staff #1 and video with family of Child #1 and Child #2.
