The licensing inspector initiated an unannounced inspection on 11/20/23 and concluded on 11/20/23 in response to a complaint received by the department on 11/15/23 for allegations regarding behavioral guidance and forbidden actions. Interviews were conducted relating to the allegations. The information gathered during the investigation support the allegation. Areas of non-compliance are identified on the Violation Notice.
Please complete the ?plan of correction? and ?date to be corrected? for each violation cited on the violation notice and return it to me within five calendar days from today. Specify how the deficient practice will be or has been corrected. Your plan of correction should contain: 1) steps to correct the noncompliance with the standard(s), 2) measures to prevent the noncompliance from occurring again; and 3) person(s) responsible for implementing each step and/or monitoring any preventive measure(s).

Standard #: 8VAC20-780-400-A Complaint related: No Description: Based on interview, the center failed to ensure behavior guidance was used to
promote children's physical, intellectual, emotional, and social well-being, and growth, and to interact with the children to provide needed help, comfort, and support.
Evidence:
1. An observer witness on 11/15/2023 a child crying in the preschool classroom. Staff 1 reprimanded the child and told him/her to, ?Be quiet.? The child was then left alone crying for about 15 minutes without intervention. The observer stated staff 1 often yelled at the children and threatened to call their mother and yelled things such as ?You?re going to lose your outside time!?, ?You?re making me use my loud voice!? and ?Stop crying.?
2. The director stated staff 1 no longer worked for the center and that none of the accusations surprised her. She retired and was ready to leave.Plan of Correction: Staff 1's last day was 11/22/23. While staff 1 was in the building she was monitored by director spoken with and given a behavior training recommendation.
Standard #: 8VAC20-780-410-1 Complaint related: No Description: Based on interviews, the center failed to ensure staff did not practice forbidden actions such as roughly handling or restricting movement.
Evidence:
1. On an observer stated witnessed on 11/15/2023 staff 1 pull a child by his wrist and drag him to the table. When he got to his chair, he flopped onto the ground and staff 1 responded by standing over him, putting one of her hands on both of his knees and held him down while she reprimanded him for ?being difficult.?
