63.2 Child Abuse & Neglect

Comments:
A complaint was received by the licensing office on December 11, 2023, regarding behavior guidance, forbidden actions, adminstration, staffing and supervision, staff qualifications, training, and background checks. An investigation was initiated on December 14, 2023, and concluded on January, 12, 2024. Interviews were conducted and records were reviewed. Based on the preponderance of evidence, the complaint regarding administration and background checks is deemed valid. Violations cited can be found on the violation notice. Description: REPEAT VIOLATION

Based on record review and interview, the center failed to obtain an out-of-state criminal history name check by the end of the 30th Day of Employment.

Evidence:
1. The record of staff #6 (hired 09/28/2023) did not contain documentation of an out-of-state criminal history check.

2. Staff #6 indicated living in another state other than Virginia within the last five years on their sworn disclosure statement dated 10/21/2023.

Plan of Correction: A Criminal Record name check will be submitted for Staff #6 immediately. Moving forward, we will ensure that the proper background checks are completed for all employees of our Extended Day and Preschool Program who have lived outside of the state of Virginia within the past 5 years. This will be done within 30 days of their employment.

Description: REPEAT VIOLATION

Based on record review and staff interview, 3 of 6 staff files indicated that the center failed to obtain a sworn statement before 1st day of employment.

Evidence:
1. The record of Staff #6 (hired 09/28/2023) sworn statement is dated 10/21/2023.
2. The record of Staff #5 (hired 02/27/2023) sworn statement is dated 08/28/2023.
3. The record of Staff #1 (hired 08/16/2023) did not have a sworn statement on file.

Plan of Correction: We will adjust our process to ensure that there is a Sworn Statement on file for each staff member working within our Extended Day or Preschool program which is signed and dated prior to their first day of employment.
Please note, Staff #1 resigned from working within our Extended Day program on 12/8/2023, prior to the licensing inspection on 12/14/2023. The file for Staff #5 included an updated sworn disclosure dated 8/28/2023, but also one dated 2/27/2023 from the original date of hire.

Description: Based on record review and staff interview, 1 of 6 staff files indicated that the facility has not ensured that each staff member has submitted documentation of a negative tuberculosis screening within the last 30 calendar days of the date of employment.

Evidence:
1. The tuberculosis test documentation on file for Staff #1 was dated 09/21/2022.
2. The hire date for Staff #1 is 08/16/2023.

Plan of Correction: We will ensure that a TB test is on record for each staff member working within our Extended Day or Preschool program that is dated within 30 calendar days of their date of employment.
Please note, Staff #1 resigned from working within our Extended Day program on 12/8/2023, prior to the licensing inspection on 12/14/2023.

Complaint related: Yes
Description: REPEAT VIOLATION

Based on record review and staff interview, 3 of 6 staff files indicated that the center failed to ensure all staff records had all the required documentation.

Evidence:
1. There was no documentation of orientation for Staff #1 hired on 08/16/2023.
2. There was no documentation of two or more references for Staff #1 hired on 8/16/2023.
3. Staff #5's reference checks were dated 4/21/2023. The date of hire for Staff #5 is 2/27/2023.

Plan of Correction: We will ensure that each staff member working within our Extended Day or Preschool program has a minimum of 2 reference checks on file which are obtained prior to employment.
We will make adjustments to our on-boarding process to ensure that each staff member working within our Extended Day or Preschool program has completed the appropriate staff orientation within the time line set forth in the Standards for Licensed Child Day Centers.
Please note, Staff #1 resigned from working within our Extended Day program on 12/8/2023, prior to the licensing inspection on 12/14/2023.
