Comments:
An unannounced inspection was initiated on 01/05/2024 in response to a complaint that was received by the licensing department on 12/21/2023 regarding allegations in the areas of supervision, behavioral guidance, forbidden actions, and operational responsibilities. The inspection was initiated on 01/05/2024 and completed on 01/12/2024. On 01/05/2024, the inspector was on site from approximately 9:57 am to 11:00 am. Interviews with staff were completed, observations were made in the center, and documentation was reviewed. Additional interviews were conducted remotely on 1/11/2024.

The preponderance of the evidence gathered during the investigation supports part of the allegation; therefore, the complaint is determined to be valid. See the violation notice for more details. Description: Based on review of documentation and interview, the center did not ensure that the center?s activities and services were maintained in compliance with the center's own policies and procedures that are required by the standards.

Evidence:
1. On 12/21/2023, the department received a complaint regarding allegations of inappropriate behavior guidance. In an interview on 1/11/2024, staff #1 (date of employment: 9/5/2023) stated that she told child #1 (age two) that she would call his father which would result in a spanking. She stated that child #1 was not listening and following directions when she threatened him.
2. The center?s family handbook contains a policy titled Positive Behavior Support. The policy reads: ?When children struggle with making appropriate behavior choices, our approach is to embrace these teachable moments by helping children learn social-emotional skills, through teaching, modeling, and coaching in the moment. Our teachers respond to children?s challenging behaviors, including physical aggression, in a manner that: provides for the safety of the child; provides for the safety of others in the classroom; is calm; is respectful to the child; and provides the child with information on acceptable behavior. Specifically, they will: use encouragement of good choices or behavior rather than focus only upon unacceptable behavior; remind a child of behavior expectations by using clear, positive statements, and modeling the desired behavior; use environmental modifications, activity modifications, adult or peer support, and other teaching strategies to support the child?s appropriate behavior; redirect behavior using positive statements; and reinforce children when they make good choices.
3. Staff #1 and administration acknowledged that the threat of physical punishment was in violation of the company?s discipline policies.

Description: Based on interview, the center did not ensure that behavioral guidance was
constructive in nature, age and stage appropriate, and intended to redirect children to appropriate behavior and resolve conflicts.

Evidence:
1. In interview, staff #1 (date of employment: 9/5/2023) stated that child #1 (age two) was not listening to instruction. Staff #1 stated that she said, ?Do I need to call daddy? Daddy and mommy are watching. If you do not listen, I am going to call daddy and he?s going to spank you.?
2. Administration acknowledged that staff #1?s actions were not constructive in nature or age and stage appropriate.

Description: Based on interview, the center did not ensure that the threat of physical punishment was forbidden.

Evidence:
1. In interview, staff #1 (date of employment: 9/5/2023) stated that she told child #1 (date of enrollment: 6/5/2023) that she was going to call the child?s father and he was going to spank him. Staff #1 acknowledged that her statement was a threat of physical punishment.
