An unannounced complaint inspection was conducted on 12/1/2023 and on 12/14/2023 in response to a complaint that was received by the Virginia Department of Education, Office of Child Care Health and Safety. Interviews were conducted with staff relating to allegations of Forbidden Actions. Based upon a preponderance of evidence, the information gathered during the investigation supports the allegations of Forbidden Actions, and the complaint is determined to be valid. Please complete the columns for 'description of action to be taken' and 'date to be corrected' for each violation cited on the violation notice, and then return a signed and dated copy to the licensing office within 10 business days. Standard #: 8VAC20-780-410-1 Complaint related: No Description: Based on staff interviews, the facility failed to ensure that the following acts or threats of are forbidden: physical punishment, striking a child, roughly handling or shaking a child, restricting movement through biding or tying, forcing a child to assume an uncomfortable position, or exercise as punishment.
Evidence: identified through staff interviews that around 1pm on Staff 1 observed Staff 2 pull child 1 up by their arm. Staff 1 noticed that Child 1 stopped using their arm, was favoring it, and was acting like it hurt them during the day, and reported the incident to the administration staff. Child went home, and parents noticied that the child was favoring their arm, causing them to take the child to urgent care where they were diagnosed with a dislocated elbow.Plan of Correction: After observing the violation, Staff #2 was immediately removed from the classroom and placed on
administrative leave pending investigation. We self-reported the violation to all required parties.
Staff #2 is no longer employed with the Everbrook Chapel Springs Location.
We re-trained all staff during staff meeting on positive reinforcement and behavior guidelines on
December 14th, 2023. Additionally, we reviewed best practices regarding transitions and
redirection of children.
A member of the management team will observe 1 Face to Name transition daily for the next 30 days
and will provide any necessary coaching on the spot to ensure clear expectations and understanding
of the process.
