Comments:
An unannounced inspection was conducted 12/19/2023 in response to a complaint regarding staffing and supervision and hazardous substances and other harmful agents. Observations, documentation, and interviews were conducted. The preponderance of evidence supported the allegations of noncompliance with standards and law. The complaint is determined to be valid.

Please sign the violation notice and complete the ?plan of correction? and ?date to be corrected? for violation cited on the violation notice and return it to me within 5 business days. The plan of correction should contain: 1) steps to correct the noncompliance with the standard(s), 2) measures to prevent the noncompliance from occurring again; and 3) person(s) responsible for implementing each step and/or monitoring any preventive measure(s).

Description: Based on observation, the provider failed to ensure hazardous substances such as
cleaning material be kept in a locked place preventing access by children.
Evidence:
The laundry closet located in the center?s hallway was open and contained laundry detergent with the warning label to keep out of reach of children.

Plan of Correction: When the unexpected licensing inspector arrived, the staff member was doing laundry and failed to lock the laundry closet door when they went to greet the licensing inspector. This was corrected immediately while the inspector was still on the premises. Employees were reminded of all areas that need to be kept locked for safety reasons. The Director and Assistant Director will monitor all areas to ensure they are locked during walkthroughs every 30-45 min. If an area is found unlocked, it will be immediately reported to the director. Training will also be implemented in our next staff meeting. This safety measure has already begun.

Description: Based on interview and reviewed documentation, the provider failed to ensure that harmful agents shall not be stored in areas, purses, or pockets that are accessible to children.

Evidence:
In a statement dated 11/30/2023, staff member, S1 documented ?I had inadvertently brought my JUUL vape pen into the school, having forgotten to remove it from my dress pocket. Unfortunately, this item fell out of my pocket in the Beginners 1 classroom and was later found by a child.? The vape pen was observed in the hand of child C1, age 2, and was removed from the child by a teacher.

Plan of Correction: The Juul e-cigarette was empty, and the battery was dead making it inoperable. Reiteration and training regarding our no smoking policy was given to staff immediately. We will be going over the policy and having all staff members sign the policy again at our next team meeting. The director and assistant director will have all new hires sign the policy separately when they are hired. This safety measure has already begun.
