An investigation was initiated in response to a complaint received by the department on 6/23/23 regarding an allegation in the area of staffing. Numerous additional complaints were received on 6/26/23, 7/18/23 and 8/8/23 regarding concerns in the areas of staffing, supervision and transportation. On-site inspections were conducted on 7/24/23 and 11/6/23. Interviews with staff were completed, a tour of the facility and center vehicles was conducted and documents related to the allegations were reviewed. Based on information gathered during the investigation, the portion of the complaint regarding transportation is determined to be valid. Violations are cited on the violation notice issued to the program and were discussed with center management at the conclusion of the investigation.

Standard #: 8VAC20-780-580-C Complaint related: Yes Description: Based on staff interviews and a review of center documents, it was determined that the center did not ensure that Virginia state statutes about safety belts are followed as required by ?46.2-1095 through ?46.2-1100 of the Code of Virginia and that stated maximum number of passengers in a vehicle is not exceeded during transportation of children.
Evidence:
1. Two staff members stated that on 7/14/23, they took 17 school-aged children on one of the centers? two vehicles for a field trip. The staff members stated that the center vehicles only have enough seats and seat belts for a maximum of 14 children.
2. Staff stated that because there were not enough seats for the number of children on the field trip, they had to sit several of the children three to a seat and some children did not have seat belts to wear. One staff member stated that she had to sit on the floor of the vehicle due to there being no seat for her to sit in.
3. The licensing inspector observed a total of 14 seat belts available on the center vehicle used to transport children.
4. There are 17 children listed on the field trip Face-to-Name sheet for 7/14/23. The staff supervising the field trip that day confirmed that the face-to-name sheet was correct and that the 17 children listed were transported on the center vehicle to and from the field trip.
5. The center director confirmed that the center vehicle used to transport children holds two children per seat for a maximum of 14 children.Plan of Correction: The center responded with the following: Bus drivers were retrained on transportation policy on August 14th and all drivers took bus driver training for FY24. No bus shall transport more than 14 children at a time. All bus procedures are audited by management periodically to ensure compliance.
