Technical Assistance:
Technical assistance given and licensing standards were reviewed regarding references in files, emergency plans posted, and 24 hour emergency supplies.

Comments:
An unannounced renewal inspection was conducted on January 18, 2024. Inspector arrived at 10am and departed at approximately 2pm. There were 36 children and 10 staff members present. The Inspector observed five children?s records and seven staff records. The Inspector observed staff and children?s interactions throughout the inspection. Children were observed lunch, free play, diapering, bottle feeding, bathroom transition to nap. Emergency preparedness documents were observed. Medications were observed. Information gathered during the inspection determined non-compliance with applicable standards or law and violations were documented. The violations are listed on the violation notice issued to the center and were reviewed with the Director and Owner at the exit interview. The inspection concluded on 1/22/24.

Violations:
Standard #: 22.1-289.035-B-4
Description: Based on record review and interview, it was determined that the center did not ensure that they obtain a copy of the results of a criminal history record information check, a sex offender registry check, and a search of the child abuse and neglect registry or equivalent registry from any state in which the individual has resided in the preceding five years.
Evidence:
1. Staff #2 (date of hire 01/17/2024) reported and signed on their Sworn Statement disclosure that they lived in another state outside of Virginia in the past five years. The out of state background checks were not completed or documented in their record.
2. Staff #1 and the owner confirmed that the out of state background check were not completed and was present at the center caring for children.
3. Staff #2 confirmed that she lived outside of Virginia in the past five years.
Repeat violation.

Plan of Correction: The center replied with the following: The center will have the out of state background checks completed and send the results to the LI and place them in Staff #2?s record. Staff will ensure to review the Sworn Statement Disclosure if they lived in another state in the past five year.

Standard #: 8VAC20-780-140-A
Description: Based on record review and interview, it was determined that the center did not ensure that each child shall have a physical examination by or under the direction of a physician before the child's attendance or within 30 days after the first day of attendance.
Evidence:
1. Child #1(date of enrollment 12/11/2023) did not have documentation of a physical examination in their record.
2. Staff #1 was unable to provide the documentation of a physical examination for Child #1.

Plan of Correction: The center responded with the following: The center will obtain the Child #1?s physical and place it in the child?s record.

Standard #: 8VAC20-780-270-A
Description: Based on observation and interview, it was determined that the center did not ensure that areas and equipment of the center inside and outside be maintained in a safe and operable condition.
Evidence:
1. In the 2 year old classroom, there is a wooden toy kitchen that has a metal bracket protruding out. It is in reach of the children in care which poses as an injuryand/or poking hazard.
2. In the toddler room, there is a book shelf on the floor that is unstable and a tipping hazard. The toddler teacher stated that the children have tried to climb the book shelf and poses as an injury and tipping hazard for the children in care.
3. In the school age room, there is a cracked and broken plastic bin that holds art supplies that is in reach of the children in care.
4. Staff #1 confirmed that in the 2 year old room, the metal bracket was protruding which poses an injury hazard and the plastic bin is cracked and broken.
Repeat violation.

Plan of Correction: The center responded with the following: The center immediately took off the metal bracket during the course of the inspection. The bookshelf will be removed from the toddler room. The broken bin will be disposed of and no longer used in the center.

Standard #: 8VAC20-780-440-J
Description: Based on observation and interview, it was determined that the center did not ensure that in the infant room, there shall be at least thirty inches of space between service sides of occupied cribs and other furniture where that space is the walkway for staff to gain access to any occupied crib.
Evidence:
1. A 4-month old child was asleep in the crib and there was not 30 inches of space between the service side of the occupied crib. The crib was against the window and another crib was approximately 15 inches away from the service side.
2. Infant lead teacher confirmed that the service side of the crib occupied was not 30 inches.

Plan of Correction: The center responded with the following: The center moved the other crib during the time of the inspection to ensure that there was at least 30 inches of space between the service side of the occupied crib.

Standard #: 8VAC20-780-550-P
Description: Based on record review and interview, it was determined that the center did not ensure that they maintain a written record of children's serious and minor injuries in which entries are made the day of occurrence. The record shall include the date and time when parents were notified.
Evidence:
1. Three of the four injury reports reviewed did not have the date and time when the parents were notified documented by staff or the director.
2. Staff #1 and the owner confirmed that there was no documentation of the date and time of how the parents were notified of the injury.

Plan of Correction: The center responded with the following: The center will develop a system to ensure that all injury reports are thoroughly fill out with all the required information per the Licensing standards.

Standard #: 8VAC20-780-560-L
Description: Based on observation and interview, it was determined that the center did not ensure that staff sit with children during meal times.
Evidence:
1. In the preschool classroom, the children were observed eating hotdogs for lunch and there was no staff member sitting with the children.
2. In the 2 year old classroom with three staff member present in the room, there were no staff members sitting with the children during their meal time.

Plan of Correction: The center responded with the following: During the inspection, the staff members were prompted by the director and owner to sit with the children. Moving forward, staff will ensure that staff will always sit with children during meal times.
