22.1 EARLY CHILDHOOD CARE AND EDUCATION

Comments:
An unannounced monitoring inspection was conducted today, January 24, 2024, as a follow-up to the issuance of a provisional license. The inspector was on site from approximately 11:00 am until 11:40 am.
The director was present and assisted in the inspection. There were 24 children present, ranging in ages from three months to two and a half years, with six staff supervising.
The inspector reviewed compliance in the areas of administration, physical plant, staffing and supervision, programming, special care and emergencies, and medication. A total of eleven staff records were reviewed.
Information gathered during the inspection determined non-compliance with applicable standards or law and violations were documented on the violation notice issued to the program.

Standard #: 8VAC20-780-40-E
Description: Based on observation and review of the license, the licensee did not ensure operational responsibilities, including compliance with the terms of the current license issued by the department.

Evidence:

1. Upon the arrival of the licensing inspector on 01/24/2024, Nine toddler age children and seven children under the age of 16 months were observed in classroom #4. The current license stipulates: ?When infants are in room 4, a maximum of seven children may be present?.
2. During the inspection on 01/24/2024, the licensing inspector observed 16 infants playing on the floor in classroom #8. The current license stipulates: ?Room 8- (formerly rooms 2 & 3) - A maximum of 13 infants may be in care at any one time?.

Standard #: 8VAC20-780-350-B-1
Description: Based on observation and interview, the center did not maintain the required staff to child children ratio for children birth up to 16 months of age.

Evidence:

1. The required staff-to-children ratio for children birth up to 16 months is one staff for every four children. At the time of the inspector?s arrival, approximately 11:00 am, there were seven Infants combined with nine toddler age children and three staff supervising.
2. A staff member stated the infants and toddlers had been combined for approximately 10 to 20 minutes. The director acknowledged the class was out of ratio. The staff to child ratio is applicable to the youngest child in the group and shall apply to the entire group.
