Comments:
An unannounced monitoring inspection was completed on Wednesday, January 31, 2024 at 8:44 am until 11:59 am at the center by the licensing administrator and the inspector. There were 9 children present, ranging in ages from infancy to 11 years, with 6 staff supervising and 2 administrative staff at the center. The inspectors completed observations of children in care in their designated classrooms working on activities on their tablets, transitioning for school, engaged in active play with age appropriate equipment, interacting with peers and staff, standing on the carpet, in their assigned crib, and staff diapering. The inspector reviewed compliance in the areas of administration, physical plant, staffing and supervision, programming, special services, background checks, and nutrition. A total of 4 child records and 4 staff records were reviewed. The focus of the inspection was to determine whether the provider had corrected or is in the process of correcting previously cited violations in the areas of standards or laws referenced above. Any non-compliant elements of standards or laws are documented in the Violation Notice of this inspection.

Pursuant to 8VAC20-820-410, General Procedures and Information for Licensure, the provider requested that the Department consider entering into a Consent Agreement in lieu of adverse action to deny the renewal application to operate a licensed child day center. On November 7, 2023, the provider submitted a final Compliance Plan to address the standards and law documented on a Notice of Intent to Deny Renewal application for a License to operate a August 28, 2023 issued. Violations:
Standard #: 22.1-289.011-F
Description: Based on observations, the center did not ensure the license and any other documents required by the Superintendent shall be posted in a conspicuous place on the licensed premises.

Evidence: The center's license was not visibly posted in a conspicuous place on the premises.

Plan of Correction: All documentation has been posted.

Standard #: 8VAC20-780-150-B
Description: Based on review of children's record, the center did not ensure all immunization reports received shall be signed by a physician, his designee, or an official of a local health department.


Evidence: In Child1's record (start date 01/2024) the immunization documentation reviewed was not signed by a physician.

Plan of Correction: The child's record will be updated by the parent.

Standard #: 8VAC20-780-70
Description: Based on review of staff records and interview, the center did not ensure to obtain all documentation of two or more references as to character and reputation before employment or volunteering.

Evidence:
1. In Staff#2's record (date of hire: 01/16/24), the two references checks were dated 01/17/24.
2. Interview with staff confirmed Staff#2's hire date.

Plan of Correction: All staff references will be checked prior to the start date.

Standard #: 8VAC20-780-280-B
Description: Based on observations and photographs, the center did not ensure all hazardous substances are kept in a locked place using a safe locking method that prevents access by children.

Evidence:
1. In the school age restroom area, there was a can of air freshener with the labels "Keep out of reach of children" and "danger" was observed on the top shelf accessible to children in care.

2. Photographs taken by the inspector of observation during the inspection.

Plan of Correction: Hazardous substances have been locked away and staff have been made aware of the policy of storing hazardous materials.

Standard #: 8VAC20-780-500-A
Description: Based on observation, the center did not ensure children's hands shall be washed with soap and running water or disposable wipe after toileting procedures.


Evidence: There was observations of diapering by Staff#1 in the infant room, Child #1 hands were not washed or wiped with a disposal wipe prior to being placed onto the carpet.

Plan of Correction: Reviewed diaper changing procedures with staff.

Standard #: 8VAC20-820-120-E-3
Description: Based on observation, the center did not ensure to posted the notice of the superintendent's intent to revoke or deny renewal of the license of a child day program in a prominent place at each public entrance of the facility to advise consumers of serious or persistent violations.

Evidence: There was only page one of the notice of the superintendent's intent to revoke or deny renewal of the license posted at each public entrance of the facility during the inspection.

Plan of Correction: All documentation has been posted

Standard #: 8VAC20-820-120-E-6
Description: Based on observation, the center did not ensure a copy of any special order issued by the department shall be posted in a prominent place at each public entrance of the licensed premises.

Evidence: During the inspection on January 31, 2024, the special order was not posted at the center at each public entrance.

Plan of Correction: All documentation has been posted.
