Comments:
An unannounced monitoring inspection was conducted on Monday, January 22, 2024 to determine the program?s compliance with licensing standards. The inspector was on site from 10:00am to approximately 11:40am. The census for today's inspection consisted of 10 children in the direct care of two staff. The center's director was present during the inspection. Upon the inspector's arrival, the children were engaged in a variety of activities. The children were observed during free-play and teacher-led activities. The center is equipped with age-appropriate materials and equipment for the children?s use. Staff were engaged with the children and offering guidance when needed. The areas where children receive care were inspected and found to be in compliance. The center had the following posted: license, daily schedule, emergency numbers, evacuation maps, menu and various parent information. The center's first aid kit and non-emergency supplies were inspected and found complete. During the inspection, five children?s records and two staff records were reviewed. Per the director, transportation is not provided at this time and there were no medications on site.

Information gathered during the inspection determined non-compliance with applicable standards or law and violations were documented on the violation notice issued to the program.

Violations:
Standard #: 22.1-289.035-B-4
Description: Based on a review of two staff records and interview, the center did not obtain the required out-of-state background checks from any state in which one staff member had resided in the preceding five years within the required timeframe.

Evidence: The record of Staff #1, employed on 02/01/23, indicated the staff had resided in another state outside of Virginia within the last five years. The record did not contain a copy of the results of a criminal history record information check or a sex offender registry check. The child abuse and neglect registry search was requested on 05/08/23, but the results were not in the record.

During interview, a member of management confirmed the out-of-state background checks for Staff #1 were not obtained within the required timeframe.

The out-of-state criminal history record information check and the sex offender registry check are required to be obtained prior to employment. The out-of-state search for founded complaints of child abuse or neglect is required to be requested within the first 30 days of employment.

Plan of Correction: The missing background checks will be requested.

Standard #: 8VAC20-780-245-A
Description: Based on a review of two staff records and interview, the center did not ensure one staff completed annually a minimum of 16 hours of training appropriate to the age of children in care.

Evidence: Staff #2, employed on 01/04/23, completed four hours of annual training from 01/05/2023-01/04/2024. During interview, a member of management confirmed Staff #2 had not completed a minimum of 16 hours of training annually.

Plan of Correction: Moving forward, management will ensure each staff has what is needed in their record.
