Comments:
An unannounced investigation was initiated on 2/12/2024 and concluded on 2/14/2024 in response to a complaint that was received by the licensing department on 2/5/2024 regarding allegations in the areas of operational responsibilities, administration and supervision. On 2/12/2024, two inspectors were on site from approximately 9:51 am to 11:00 am. Interviews with staff were completed, observations were made in the center, and documentation was reviewed. Additional interviews were conducted remotely.

The preponderance of the evidence gathered during the investigation supports the allegation; therefore, the complaint is determined to be valid. In addition to the original complaint, there were also violations found during the inspection regarding background checks and staff record requirements. See the violation notice for more details.

Description: Based on record review and interview, the center did not ensure one staff completed a sworn statement prior to the first day of employment as required.

Evidence:
1. The record of staff #1 (date of employment: 1/3/2024) contained a sworn statement dated 1/4/2024.
2. Administration acknowledged that the sworn statement was completed after the first date of employment.

Description: Repeat Violation

Based on record review and interview, the center did not ensure to obtain documentation of a negative tuberculosis screening at the time of employment and prior to coming into contact with children.

Evidence:
1. The record of staff #1 (date of employment: 1/3/2024) contained a TB screening dated 1/10/2024.
2. Administration acknowledged that the TB screening was completed after the start of employment.

Description: Based on a review of documentation and interview, the center did not inform all staff who work with children of children's allergies, sensitivities, and dietary restrictions as required.

Evidence:
1. In interview, staff #1 (date of employment: 1/3/2024) stated that she fed child #1 (date of enrollment: 8/21/2023) carrots on 1/31/2024. Staff #1 was not aware of child #1's food allergy to carrots. The child's food allergies were not posted on the allergy list and staff #1 had not been made aware during orientation. Staff #1 was notified of child #1's allergies when the parent of child #1 disclosed that he had an allergic reaction after consuming the carrots. Staff #2 stated that she was aware of child #1's food allergies because he had been fed carrots at the center before and the parent had informed the center that he was allergic.
2. Administration acknowledged that staff were not properly informed of child #1's food allergies.

Plan of Correction: Staff have been retrained on children's allergies and sensitivities. Training on all allergies will be added to orientation trainings before teachers interact with children.

Complaint related: Yes
Description: Based on a review of documentation and interview, the center did not ensure to maintain in a way that was accessible to all staff who work with children, a current written list of all children's allergies, sensitivities, and dietary restrictions.

Evidence:
1. On 1/31/2024, child #1 (date of enrollment: 8/21/2023) was fed carrots during morning snack. Child #1's allergy information was not included on the allergy lists in the center. Child #1's food allergies were listed on the enrollment form, new student questionnaire, and on the immunization form from the child's physician.
2. Administration stated she was made aware of the food allergy after the parent reported that the child had an allergic reaction to the carrots. She stated that the allergy list was updated to include child #1 after the incident on 1/31/2024.

-allergy information added to brightwheel to ensure a backup source of allergy information

Complaint related: Yes
Description: Based on a review of documentation and interview, the center did not ensure to obtain a written care plan for each child with a diagnosed food allergy, to include instructions from a physician regarding the food to which the child is allergic and the steps to be taken in the event of a suspected or confirmed allergic reaction.

Evidence:
1. The record of child #1 (date of enrollment: 8/21/2023) did not contain a written care plan. The child's record contained two documents where the parent disclosed the child's food allergies and one medical document from the child's physician that listed the child's diagnosed food allergies to include carrots.
2. Administration acknowledged that they did not have an allergy care plan for child #1.

Plan of Correction: A written care plan will be requested from parents for all students with diagnosed allergies.

Standard #: 8VAC20-780-340-A
Complaint related: Yes
Description: Based on a review of documentation and interview, the center did not ensure that when supervising children, they always ensure their care and protection.

Evidence:
1. On 1/31/2024, Child #1 was fed carrots, a food he is allergic to. Child #1's record contained documentation of the food allergies. The parent reported that child #1 developed hives and discomfort that lasted approximately five days, and the child was seen by a physician. She reported that child #1 had been fed carrots at the center before, and that she had reminded them of the child's allergies.
2. Administration acknowledged that child #1 was served an allergen due to improper documentation on the part of the school. Staff #2 also confirmed that child #1 had previously been fed an allergen at the center.

-New color coded filing system for allergens implemented 2/5/24 will continue to use.
