Comments:
A monitoring inspection was initiated and concluded on 2/15/2024. The inspector arrived at 9:07 AM and departed at 11:10 AM . There were 23 children present, ranging in ages from infant to 5 years, with 4 staff supervising. The inspector reviewed compliance in the areas of administration, physical plant, staffing and supervision, programming, medication, special care and emergencies and nutrition. A total of 3 child records and 3 staff records were reviewed.

Information gathered during the inspection determined non-compliance with applicable standards or law and violations were documented on the violation notice issued to the program and discussed with the program director during the exit interview

Violations:
Standard #: 8VAC20-780-140-A
Description: Repeat violation
Based upon review of children's records, the facility has not ensured that each child's record includes documentation of a physical examination by or under the direction of a physician within 30 days prior to attending.
Evidence:
According to the record provided, child 1 began attending on 11/21/2022. The record did not include the results of a physical examination.

Plan of Correction: The facility responded with the following:
The parent will be notified that documentation of a physical examination must be obtained. In the future, documentation of physical exams will be obtained within 30 days after attending.

Standard #: 8VAC20-780-60-A
Description: Repeat violation
Based on review of children's records and staff interview, the facility has not ensured that children's records include information regarding parents/guardians and the first day of attendance.
Evidence:
1. The record provided for child 2 included a temporary custody agreement that expired on 11/7/2022. There was no information regarding the mother, the father and current custody arrangements.
2. The record provided for child 2 did not include the required information regarding the father or custody documents. A father is identified on the birth certificate.
3. The record provided for child 2 did not include the child's first date of attendance.
4. Staff 1 acknowledged the missing information in the above listed children's records.

Plan of Correction: The facility responded with the following:
All children's records will be checked to ensure that all required documentation is included. Care will be taken to ensure required custody documentation is obtained.

Standard #: 8VAC20-780-350-B-2
Description: Based upon observation and staff interview, the facility has not ensured that there is one staff for every five children from 15 months - 24 months.
Evidence:
1. Upon arrival of the inspector at 9:07 AM until departure of the inspector at 11:10 AM, there were seven children the youngest of whom was 17 months old with staff 3.
2. Staff 1 acknowledged that two staff were unable to come to work today.

Plan of Correction: The facility responded with the following:
Two staff were unable to come to work today. In the future we will ensure that enough staff are on hand to meet required staff:child ratios.

Standard #: 8VAC20-780-550-O
Description: Based upon review of written minor injury records, the facility has not ensured that they notify parents by the end of the day of any known minor injuries.
Evidence:
1. An injury record dated 1/8/2024 for child 4 documented that the parent was not notified of the child's injury until the next morning, 1/9/2024 at 7:30 AM.
2. An injury record dated 1/24/2024 for child 5 was not signed by the parent until 1/25/2024.

Plan of Correction: The facility responded with the following:
In the future, we will ensure that parents are notified of minor children's injuries the same day of the injury. Documentation will clearly indicate the date, time and how the parent was notified.

Standard #: 8VAC20-780-550-P
Description: Based upon review of the written records of children's injuries, the facility has not ensured that the record includes all required documentation.
Evidence:
An injury record dated 2/14/2024 did not include the time and how the parent was notified of the injury.

Plan of Correction: The facility responded with the following:
In the future, we will ensure that parents are notified of minor children's injuries the same day of the injury. Documentation will clearly indicate the date, time and how the parent was notified.
