The licensing inspector conducted an unannounced joint inspection with a local agency on December 6, 2023 from approximately 2:15 PM to 3:30 PM. The complaint inspection is in response to a complaint that was received by the licensing department on November 27, 2023, regarding allegations of staffing and supervision. Interviews with staff were completed, observations were made in the center, and documentation was reviewed. On December 12, 2023, the inspector conducted additional interviews and follow-up activities from approximately 12:00 PM to 12:15 PM.
The preponderance of the evidence gathered during the investigation supports the allegation; therefore, the complaint is determined to be valid. Though not a part of the original complaint, there were violations found during the inspection regarding children?s records. See the violation notice for more details.
Please complete the plan of correction and the date to be corrected for each violation listed on the violation notice and return it to the department within 5 business days from receipt. Your plan of correction should contain: 1) steps to correct the noncompliance with the standard(s); 2) measures to prevent the noncompliance from occurring again; and 3) person(s) responsible for implementing each step and/or monitoring any preventative measures. Standard #: 8VAC20-780-140-A Complaint related: No Description: Based on a review of children's records, the center did not ensure that each child shall have a physical examination by or under the direction of a physician before the child's attendance or within one month after attendance.
Evidence:
The record for child A (enrolled: 03/06/23) did not have a physical examination.

Standard #: 8VAC20-780-340-A Complaint related: Yes Description: Based on interviews, the care, protection, and guidance of one child was not ensured by supervising staff.
Evidence:
On November 15, 2023, staff #1 and staff #2 were on the preschool playground with six toddler children. During the transition from the playground back to the classroom, child A (1 year, 11 months) got her hair stuck in a standard size picnic table with a perforated metal tabletop. Staff #1 and staff #2 were unaware that child A had gotten her hair stuck in the perforated metal tabletop until Staff #1 heard child A whine.
