Comments:
An unannounced monitoring inspection was conducted on February 28, 2024 between the hours of 2:40pm and 5:03pm . There were a total of 37 children with 8 staff members supervising. Children were observed reading books, playing with various manipulatives, puzzles, toileting, handwashing, diapering, snack time, engaged in group activities and class dismissal. Positive interaction was observed between staff and children. The inspector reviewed compliance in the areas of administration, physical plant, staffing and supervision, programming, medication, children and staff records, special care and emergencies. The information gathered during the inspection determined non-compliance with applicable standards or law and violations were documented on the violation notice issued to the facility. Repeat violations were found and are identified within this report.

Violations:
Standard #: 22.1-289.035-B-2
Description: Based on record review and interview, the center did not obtain a criminal history record check prior to the 1st day of employment.
Evidence:
1. The criminal history record check (dated 08/23/23) was not obtained for Staff #2 prior to the first day of employment (DOH 08/02/23)
2. The director acknowledged the criminal history record check was not completed on the 1st day of employment for Staff #2.

Plan of Correction: The search was conducted prior to school starting on 8/24/23. I will ensure background searches are completed by the date of employment.

Standard #: 22.1-289.035-B-4
Description: Based on record review and interview, the center failed to ensure that out of state background checks were conducted as required.
Evidence:
1. Staff #2 (DOH 8/2/23) indicated on the sworn disclosure statement dated 7/27/23 that they had lived outside the state of Virginia within the past five years. There was no documentation to support that the required out of state criminal history record check had been completed prior to employment or that a search of the child abuse and neglect registry was submitted within 30 days as required. (DC).
2. The director verified that an out of state criminal history check and search of the child abuse and neglect registry (CPS check) were not completed for Staff 2.

Plan of Correction: My previous assistant director had handled all of the paperwork. I will submit all of the out-of-state searches immediately.

Standard #: 8VAC20-780-160-A
Description: Based on record review, the documentation of tuberculosis screening was not submitted at the time of employment.
Evidence: Staff #2 (DOH 08/02/23) TB screening was conducted on 08/11/23.

REPEAT VIOLATION

Plan of Correction: The staff attended in-service training and setting up her classroom but she did not come into contact with any children because school started 8/24/24.

I will obtain TB screening results on the first day of employment for all new employees.

Standard #: 8VAC20-780-550-D
Description: Based on record review and interview, the center failed to implement a monthly practice evacuation drill.
Evidence:
1. There was no documentation of a monthly practice evacuation drill for January 2024.
2. The director stated an evacuation drill was not conducted in January 2024.

REPEAT VIOLATION

Plan of Correction: We didn't conduct a drill in January due to the weather conditions. I will ensure we conduct the drills each month as required.
