Comments:
A monitoring inspection was conducted from 11:00 AM to 2:30 Pm on 02/27/2024. There were 62 children present, ranging in ages from three months to five years, with 18 staff. The inspector reviewed compliance in the areas of administration, physical plant, staffing and supervision, programming, medication, special care and emergencies. A total of six children?s records, six staff?s records, and one child?s medication and supporting documents were reviewed. Violations from the previous inspection were reviewed. One repeat violation was found.
Information gathered during the inspection determined noncompliance with applicable standards or law and violations were documented on the violation notice issued to the facility.
Correction made to violation notice 03/15/2024 and 03/22/2024 to identify the repeat violation of standard 8VAC20-780-(5)-340-D.

Violations:
Standard #: 8VAC20-780-40-E
Description: Based on observation and a review of the center's policies and interview, the licensee failed to ensure the center's activities were in compliance with the center's own policies and procedures required by these standards.

Evidence:

1. The center's safe sleep policy indicates that staff members are required to complete online training regarding preventing shaken baby syndrome and safe sleep practices and staff members are required to follow the guidance that is given in these trainings at all times. Interview with staff 7 confirmed that the policy does not allow infants sleeping on Boppy pillows or having blankets.
2. In the Kind Koalas infant room, a three month old infant was observed sleeping on the floor on a Bobby pillow with a security blanket over the infants face.

Plan of Correction: The staff will be retrained on Safe Sleep; time for training began on February 28, 2024 and will be completed by all infant caregivers by March 28, 2024. A supervisor will check on the classroom every 20 minutes to ensure safe sleep habits are prioritized; this routine began on February 28, 2024.

Standard #: 8VAC20-780-340-A
Description: Based on observation, the center failed to ensure the care, protection, and guidance when supervising children.

Evidence:

1. A three and month old infant in the Kind Koalas infant room was observed sleeping on the floor on a Boppy pillow with a security blanket over the infant's face. Three staff observed the infant and took no actions. A a few minutes later a different staff member moved the security blanket off the infant's face but did not remove the blanket. The blanket was not removed and the infant was not moved from the Boppy pillow until the inspector intervened.
2. The warning label on the Boppy pillow states the following:
-Never allow baby to sleep on the Boppy pillow.

Plan of Correction: The staff will be retrained on Safe Sleep; time for training began on February 28, 2024 and will be completed by all infant caregivers by March 28, 2024. A supervisor will check on the classroom every 20 minutes to ensure safe sleep habits are prioritized; this routine began on February 28, 2024.

Standard #: 8VAC20-780-340-D
Description: (REPEAT VIOLATION AND SYSTEMIC VIOLATION) Based on interview, the center failed to ensure each grouping of children have at least one staff member who meets the qualifications of a program leader or program director.

Evidence:

1. Staff 5 was one of the staff in the Dancing Dinosaurs classroom and staff 6 was one of the staff in Busy Bees classroom. Interview with the director revealed that there were no staff members meeting the qualifications of a program leader or program director in the Dancing Dinosaurs or Busy Bees classrooms.

Plan of Correction: Two Professional Development Days will be implemented into the routine closure and holiday list for the center that allow for specific annual training to be conducted, this routine previously began on January 15, 2024 and will remain on the calendar indefinitely.
