63.2 Child Abuse & Neglect

Comments:
A monitoring inspection was initiated on 01/25/24 from 9:14 a.m. to 12:56 p.m. in response to a self-reported incident regarding behavior guidance. Based on staff interviews that were conducted and documentation reviewed violations were cited in regard to the self-report. If you have questions regarding this inspection, please contact the Licensing Inspector, Beth Velke, at beth.velke@doe.virginia.gov.

Please complete the "Plan of Correction" and "Date to be Corrected" areas on the Violation Notice for each violation cited and return to me by 5 p.m. on 03/18/24.

Violations:
Standard #: 63.2-1509-A
Description: Based interviews and documentation, the center failed to report a suspected incident of child abuse or neglect to Child Protective Services immediately as required.

Evidence: On 1/19/24, center staff contacted the licensing office to report a head injury a three-year-old sustained from a teacher pulling a blanket out from underneath a child while they were jumping on a cot. The incident occurred on 1/18/24, at least three staff members were aware of the injury, and that it was caused by center staff, but the incident was not reported to the local department until the licensing inspector advised them to do so.

Plan of Correction: The center staff reported the incident to licensing withing 24 hours. At that time, licensing informed the center staff that CPS must be called immediately in these incidents. The center staff now understands and will report to Child Protective Services immediately as required.

Standard #: 8VAC20-780-340-A
Description: Repeat Violation

Based on observed evidence and interviews, staff did not ensure the care, protection, and guidance of children in care.

Evidence: On 1/18/24, at approximately 12:56 p.m., Child #1 sustained a head injury from falling and hitting their head, after a teacher pulled a blanket out from under them. Staff #2, sitting next to Child #1 at the time of the incident, failed to administer first aid to the injured child and did not report the incident to management until approximately 3:20 p.m.

Plan of Correction: Staff #2 was retrained in reporting incidents in a timely manner.

The involved staff member was separated from care of children immediately, and separation of employment was the end result.

Standard #: 8VAC20-780-400-B
Description: Repeat Violation

Based on observed evidence and interviews, the center did not ensure that behavioral guidance was constructive in nature and redirected children to appropriate behavior and resolve conflicts.

Evidence: According to observed evidence and interviews, on 1/18/24, at approximately 12:56 p.m., Child #1, three-years-old, was jumping up and down on their cot. Staff #1 walked over to Child #1?s cot and pulled a blanket out from underneath Child #1 as Child #1 was jumping, placed the blanket on the table and walked out of the classroom. An interview with staff confirmed when the blanket was pulled out from underneath Child #1, they fell backward, hit the back of their head on the cot and began to cry.

Plan of Correction: Staff#1 was separated from care of children immediately, and separation of employment was the end result.

Standard #: 8VAC20-780-550-P
Description: Based on review of documentation and interview, the center did not maintain a written record of children's serious and minor injuries in which entries were made the day of occurrence.

Evidence: On 1/18/24, a three-year-old child received a head injury in the classroom at approximately 12:56 p.m. An interview with staff confirmed the center did not create a written report of the injury.

Plan of Correction: The center will create a written record for children's serious and minor injuries. Staff have been retrained in documentation of these types of incidents.
