Comments:
An unannounced investigation was initiated on 2/22/2024 in response to a self-report that was received by the licensing department on 2/12/2024 regarding allegations in the areas of injury reporting, forbidden action, and care and protection. The inspection was initiated on 2/22/2024 and completed on 3/14/2024. On 2/12/2024, the inspector was on site from approximately 10:26 am to 1:20 pm. Interviews with staff were completed, observations were made in the center, and documentation was reviewed. An additional interview was conducted remotely. The preponderance of the evidence gathered during the investigation supports part of the allegation; therefore, the self-report is determined to be valid. See the violation notice for more details.

Please complete the plan of correction and date to be corrected for each violation cited on the violation notice and return it to me within 5 business days from today. You will need to specify how the deficient practice will be or has been corrected. Just writing the word corrected is not acceptable. Your plan of correction must contain: 1) steps to correct the noncompliance with the standard(s), 2) measures to prevent the noncompliance from occurring again; and 3) person(s) responsible for implementing each step and/or monitoring any preventative measures. Please do not use staff names; list staff by positions only.

Violations:
Standard #: 8VAC20-780-340-A
Description: Based on a review of video footage, documentation and interview, the center did not ensure that when staff are supervising children, they shall always ensure their care and protection.

Evidence:
1. On 2/9/2024, child #1 (date of enrollment: 11/6/2023) sustained injuries on her arms when she was roughly placed on her cot by staff #1 (date of employment: 5/10/2023). In video footage, staff #1 is observed placing child #1 on a cot and subsequently checking the undersides of her arms on two separate occasions. The areas of the child?s injuries were consistent with fingernail marks and were located in the areas where staff #1?s hands were placed as well as where staff #1?s areas of focus were during her examinations. The parents of child #1 discovered the injuries and reported that child #1 received medical attention.
2. Administration acknowledged that child #1 was not properly cared for.

Plan of Correction: The center will continue to monitor classrooms and support staff members throughout the day to ensure proper care and protection.

Standard #: 8VAC20-780-410-1
Description: Based on review of video footage, documentation, and interview, the center did not ensure that the action of roughly handling a child was forbidden.

Evidence:
1. In a video from 2/9/2024, staff #1 (date of employment: 5/10/2023) is observed attempting to get child #1 (age: 16 months) to lay on her cot during nap time. Child #1 is visibly upset and heard crying. Staff #1 is seen repositioning child #1 by holding both of her upper arms and laying her on her stomach. After repositioning the child, she is observed lifting and checking under both of the child?s arms. Approximately three hours after the repositioning on the cot, staff #1 is seen lifting and examining the undersides of child #1?s arms for a second time while laying her on the changing table.
2. The parents of child #1 reported that they discovered fingernail marks on the underside of both of child #1?s upper arms. The areas of the marks were consistent with the actions observed on the video footage provided by the center.
3. Administration acknowledged that child #1 was not handled appropriately.

Plan of Correction: Center will review and disseminate forbidden actions with all staff members.
