An unannounced complaint investigation was initiated on 1/11/2024 and completed on 3/11/2024 regarding concerns of Staffing and Supervision, Special Services, Operational Responsibilities, and Programs. An inspection was conducted on site 2/6/2024 in which two staff records, 7 children?s records as well as additional documentation, authorizations, policies and procedures were reviewed. Three staff were interviewed during the on site inspection.
Additionally, during the investigative process, contact with the local agency was made, interviews of collateral witnesses as well as 2 public school personnel were conducted. Video footage of the arrival of children transported to public school by the licensed program on 1/8/2024 was viewed.
The preponderance of the evidence gathered during the investigation does support the allegations related to Staffing and Supervision, and Special Services. Therefore, the complaint is determined to be valid. The inspection determined non-compliance with applicable standards or law and violations were documented on the violation notice issued to the program. Standard #: 8VAC20-780-40-E Complaint related: Yes Description: Based on a review of documentation and interview, the licensee did not maintain operational responsibilities, to include ensuring that the center's activities, services, and facilities are maintained in compliance with these standards, the center's own policies and procedures that are required by these standards, and the terms of the current license issued by the department.
Evidence:
The center's written Transportation Policy provided to the licensing inspector during the onsite inspection on 2/6/2024, says ?School age students will arrive and depart on a Suffolk Public School bus?. This policy is located on Page 8 of the Parent Handbook.
Staff #3 confirmed that she transported 6 children to school in her personal vehicle on the morning of 1/8/2024.Plan of Correction: The following written plan of correction was received via email from the licensee:

Standard #: 8VAC20-780-340-A Complaint related: Yes Description: Based on a review of video footage and interviews, staff failed to ensure the care, protection, and guidance of children who they were supervising.
Evidence:
On the morning of 1/8/2024, staff #3 transported 6 children in care to school, in her personal vehicle, which did not have sufficient seats or seatbelts for 6 passengers and a driver. The vehicle is designed with a total of 5 seats and 5 seatbelts.
The six children who were transported to school on 1/8/2024 were between 3 years old and 9 years old.
The vehicle was not outfitted with the required child safety restraints for the three children being transported who were 3 to 4 years of age.Plan of Correction: The following written plan of correction was received via email from the licensee:
"Staff can only transport children in daycare van."
Standard #: 8VAC20-780-580-C Complaint related: Yes Description: Based on video viewed, written documentation, and interviews, the licensee failed to ensure that during transportation of children, Virginia state statutes about safety belts and child restraints are followed as required by ?? 46.2-1095 through 46.2-1100 of the Code of Virginia, and stated maximum number of passengers in a given vehicle is not exceeded.
Evidence:
Video footage viewed at the Suffolk School Administration Office on 2/6/2024 showed 6 children exiting a 5 passenger vehicle which pulled in front of the school at approximately 9:25 am on 1/8/2024. The children exited the vehicle on the sidewalk side of the car and a school staff member escorted them down the sidewalk toward the school as the car?s driver drove away from the school.
The ages of the children documented and verbally confirmed to have been transported by staff #3 to this school on the morning of 1/8/2024, were 3 years old, 4 years old, 4 years old, 7 years old, 8 years old and 9 years old.
This vehicle being used to transport the 6 children did not have adequate seats, seatbelts or child restraints to accommodate 6 children.
One child reported having sat in the lap of another child while being transported on 1/8/2024.
The distance from the center to the school is approximately 5 miles.
Staff #3 acknowledged during an interview on 2/6/2024 that she transported these 6 children in her personal vehicle, which seats five people, on the morning of 1/8/2024 when the center?s van would not start.Plan of Correction: The following written plan of correction was received via email from the licensee:
"Children will seatbelts during van ride"
