Comments:
A self-reported incident was received on March 2, 2023, and initiated on the same day regarding inappropriate discipline. The investigation concluded on March 7, 2024. During the investigation staff, a child and a parent were interviewed, child and staff record, and video footage were reviewed. Based on the information gathered the incident is found to be valid. Violations regarding forbidden actions were found, discussed with management and appear on the violation notices.

Violations:
Standard #: 8VAC20-780-410-1
Description: Based on observation and interview the center failed to ensure that the actions or threats thereof including roughly handling a child are forbidden.
Evidence:
1 - Four staff report that on March 1, 2023, Staff #1 was observed roughly handling Child #1, a five-year-old child in care. Staff who witnessed the event made the following statements during in person interviews and in written statements.
- ?Staff #1 lowered the student to floor very fast in what I would consider an aggressive manor.? The child appeared to have a startled look on her face and tears in her eyes.?
- ?He picked the child up by the collarbone area of her clothes and aggressively lifted her out of the classroom. When she landed on the floor by the lunch clock carts and sat crying.?
- ?Staff #1 lifted her up by her arms. She had her arms bent because she was holding both hands near her mouth and crying and slammed her down on the floor in the hallway.?
- ?Staff #1 lifted her up in the air. Staff #1 was talking and shaking Child #1. Then staff one slammed child one on the floor. Child one was crying uncontrollable.?
2 ? Video footage shows Staff #1 enter the classroom behind Child #1. Staff #1 grabs the child from behind, lifts the child up off the floor and carries her out of view of the classroom camera.

Description: Based on observation and interview the center failed to ensure that the actions or threats thereof including verbal remarks which are demeaning to the child are forbidden.
Evidence:
1 - Four staff report that on March 1, 2023, Staff #1 was observed using demeaning remarks while speaking to Child #1, a five-year-old, in care. Staff who witnessed the event made the following statements during in person interviews and in written statements.

- Staff #1 was ?speaking very loudly with the use of profanity. yelling "if you act like an adult, I'm going to treat you like an adult". And once in the hallway Staff #1 ?yelled and you can't even spell your [expletive] name."

- ?There was profanity being thrown around? by Staff #1.

- Staff #1 yelled at Child #1, ?I told you to be quiet. Don't say another word. He walked up to her and put his face in her face, and he yelled. I said don't say another word. I don't care what you say, shut your [expletive] mouth.?

- Staff #1 said ?you get on my [expletive] nerves.?

2 ? Staff #1 was heard on video footage making the following statement to Child #1, a five-year,-old child in care ? Let me tell you, I will whoop your [expletive]. Ok. Let?s go. Cause I?m tired of your mouth little girl. You?re not grown. Let?s go! Let?s go! You break bad with me I?m going to break with you! You talk back to me I?m a talk back to you. You?re not grown?.Learn to spell your [expletive] name.
