Comments:
An unannounced complaint inspection regarding behavioral guidance and staffing and supervision, was conducted on-site on March 11, 2024 and concluded March 18, 2024. The inspector was on-site on March 11, 2024 from 1:50pm until 2:50pm. There were 41 children in care, ranging in ages from 2 years to 5 years, with 8 staff supervising. The inspector reviewed compliance in the areas of administration, staffing and supervision, and programs. Interviews were conducted and records were reviewed.

The evidence gathered during the investigation supported the allegations of non-compliance with standards or law and violations were issued. Any violations not related to the complaint but identified during the course of the investigation can be found on the violation notice.

Please complete the ?plan of correction? and ?date to be corrected? for each violation cited on the violation notice and return it to me within 5 business days from today. Please specify how the deficient practice will be or has been corrected. Description: Based on a review of policies and interview, the licensee failed to ensure that the center's activities, services, and facilities are maintained in compliance with the center's own policies and procedures that are required by these standards.
Evidence: 1. The center's policy states that "behavioral guidance shall be constructive in nature, age and stage appropriate, and shall be intended to redirect children to appropriate behavior and resolve conflicts.
2. Staff #1 reported that a weighted vest was used on child #1 (age 3) due to the child's "significant issues".

Based on interviews, the center failed to ensure when staff are supervising children, they shall always ensure their care, protection, and guidance.
Evidence: 1. Without written parental permission the center has been placing a weighted vest on child #1 (age 3), since the child enrolled in December 2023. This weighted vest has been placed on the child at various intervals of up to and over an hour at a time during outside play and naptime.
2. According to the American Academy of Pediatrics (AAP); AAP does not recommend the use of weighted vests for typically developing children. The AAP indicates that weighted vests can be worn in consultation with an Occupational Therapist (OT) as part of a plan with children with specific sensory processing disorders or developmental challenges. According to guidelines from OT children should wear the vest in short 15-20 minute intervals and never at naptime.
3. The weighted vest placed on child #1 belonged to a previously enrolled child who was under the care of an OT. Child #1 is not under the care of an OT, nor has an OT been consulted regarding the use of this weighted vest for child #1.

Description: Based on interview, the center failed to ensure behavioral guidance shall be constructive in nature, age and stage appropriate, and shall be intended to redirect children to appropriate behavior and resolve conflicts.
Evidence: 1. Due to behaviors and in an effort to calm child #1 (age 3), the center has been placing a weighted vest on child #1 at various intervals through the day consisting of periods of over an hour at a time to include nap and playtime.
