Comments:
An unannounced non-mandated monitoring inspection stemming from a self-reported incident regarding the areas of staffing and supervision, was conducted on-site on March 13, 2024 from 1:07pm until 1:45pm and concluded remotely on March 25, 2024. There were 114 children in care, ranging in ages from 2 years to 5 years, with 22 staff supervising. The inspector reviewed compliance in the areas of administration and staffing and supervision, documents were reviewed and interviews were conducted.

Information gathered during the inspection determined non-compliance with applicable standards or law and violations were documented on the violation notice issued to the program.

Please complete the ?plan of correction? and ?date to be corrected? for each violation cited on the violation notice and return it to me within 5 business days from today. Please specify how the deficient practice will be or has been corrected. Your plan of correction should contain: 1) steps to correct the noncompliance with the standard(s), 2) measures to prevent the noncompliance from occurring again; and 3) person(s) responsible for implementing each step and/or monitoring any preventative measures. Please do not use staff names; list staff by positions only.

Violations:
Standard #: 8VAC20-780-40-E
Description: Based on a review of records and staff interview, the licensee failed to ensure that the center?s activities, services, and facilities are maintained in compliance with these standards, the center?s own policies and procedures that are required by these standards, and the terms of the current license issued by the department.
Evidence: 1. On page 3 of the center?s health and safety standard operating procedures (SOP) regarding the policy for identifying where attending children are at all times it states ?when transitioning from one location to another, teachers will use the Name-to Face Transitions section of the child supervision record (CSR) to confirm all children are accounted for during transitions, whether that be a transition within the classroom or across thresholds.? The SOP gives the example when leaving the classroom to go to the playground, complete the name-to-face before crossing the threshold out of the classroom and again after crossing the threshold to into the playground. Make sure to actually look at each child?s face and verify if they?re with you instead of just counting children.
2. In interviews with two staff it was reported the name-to-face check was not completed when the children were transitioning from the playground back to the classroom.
3. Child #1 (age 3) was left alone on the playground for approximately 5 minutes from 3:59pm until 4:04pm.

Plan of Correction: Director, AD, Program Specialist will model and observe name to face transitions throughout the day. Visual checkpoint reminders where placed on doors to playgrounds reminding teachers to conduct name to face transitions before crossing the thresholds.

Standard #: 8VAC20-780-340-A
Description: Based on staff interviews, the center failed to ensure when staff are supervising children, they shall always ensure their care and protection.
Evidence: 1. On 03/12/2024, name-to-face checks were not completed, resulting in child #1 (age 3) being left alone outside on the playground for approximately 5 minutes from 3:59pm until 4:04pm. It was unknown that the child was left outside until another staff entered the playground.
2. The playground is surrounded by a climbable chain-link fence adjacent to a roadway.

Plan of Correction: Teachers were immediately retrained on how to conduct proper name to face checks using the required CSR (child supervision record) not just counting children but actually looking at the children as their names are called.

Standard #: 8VAC20-780-340-F
Description: Based on staff interviews, the center failed to ensure children under 10 years of age always shall be within actual sight and sound supervision of staff.
Evidence: 1. Child #1 (age 3) was left outside on the playground during transition back to the classroom for approximately 5 minutes from 3:59pm to 4:04pm on March 12, 2024.

Plan of Correction: Teachers and director also developed a plan where one teacher will conduct the name to face and upon completion the second teacher will call each child's name as they enter the building/classroom with the 1st teacher positioning themselves at the end of the line to ensure all children enter the center.
