An unannounced renewal inspection

Comments:
The licensing inspector conducted an unannounced complaint inspection in response to an incident regarding supervision that occurred at the center on November 4, 2022. The Department was notified of the incident on November 28, 2022. The inspection was initiated on December 6, 2022 and completed on December 7, 2022. On December 6, 2022, the licensing inspector was on site from approximately 10:45 am until 12:00 pm. Interviews were completed, observations were made in the center, and documentation was reviewed. Additional documentation was received and reviewed on December 7, 2022. The preponderance of the evidence gathered during the investigation validates the complaint regarding supervision, therefore the complaint is valid.
Please complete the 'plan of correction' and 'date to be corrected' for each violation cited on the Violation Notice and return it to me within 5 business days from the date of receipt. Please specify how the deficient practice will be or has been corrected. Your plan of correction should contain: 1) steps to correct the noncompliance with the standards, 2) measures to prevent the noncompliance from occurring again, and 3) person(s) responsible for implementing each step and/or monitoring any preventative measure(s).

Description: Based on review of the center?s policies and procedures and interviews, the center did not ensure that the center?s activities and services were in compliance with the center?s own policies and procedures related to supervision that are required by the standards.
Evidence:
1) During interviews, staff #1 reported that on 11/04/2022, during the transition from the classroom to the outdoors, Child #1, two-years old, was mistakenly left in the classroom unsupervised for approximately 15 minutes. Staff #1 reported that a name-to-face check was not completed upon exiting the classroom. Staff #1, staff #2, Staff #3 and staff #4 were unaware that Child #1 was left behind in the classroom. Staff #1 reported that at approximately 10:35 am, the parent of child #1 texted staff #1 asking if child #1 was ok as she did not see him in any photos that were being sent out of the nature walk. Staff #3 returned to the classroom where child #1 was waiting by the door.
2) The center?s Child Supervision Policy stated, ?Classroom teachers are responsible for the supervision and whereabouts of the children assigned to their care at all times, which entails conducting regular headcounts. Name to face head counts are to be done anytime the class is leaving the room to go outside to the playground, once on the playground and going on field trips to ensure no child is hiding or left behind. ?

Description: Based on interview and video footage reviewed, the center did not ensure that children under 10 years of age always shall be within actual sight and sound supervision of staff.

Evidence:

On November 1, 2022, staff #1 and staff #2 assisted children into a wagon just outside the classroom door while staff #3 and staff #4 lined the remaining children up to go for a nature walk. Staff #1 stated she did not conduct a head count. While on the nature walk photos were taken of the children and posted on the Pro-care app for parents. At 10:35, The parent of child #1 texted the center and asked if her child was ok as she did not see him in any photos. Staff #1 stated at that point she did a head count and child #1 was not with the group. Staff #3 ran back to the classroom where she found Child #1 standing at the door. Staff #1, staff #2, staff #3 and staff #4 were unaware that Child #1 was left behind in the classroom until they were notified by the parent. It is estimated that Child #1 was out of sight and sound supervision for approximately 15 minutes.
