8VAC20-790 Subsidy Program Vendor Requirements for Family Day homes

Technical Assistance:
Technical assistance was offered related to: attendance records and children's records. Training resource was emailed to vendor.

Comments:
An in-person annual subsidy inspection was conducted on 8/15/22 from 10:10 am to 10:40 am, and continued on 8/23/22 from 10:00 am to 11:15 am. On 8/15/22 there were 3 daycare children (4 points) in care of two household members. On 8/23/22 there was 1 daycare child (4 points) present with 1 caregiver. The children were observed watching cartoons on television, getting diapered, and eating morning snack. The morning snack included banana and a fruit pouch. The inspector reviewed 4 children's records, 2 caregiver's records, 2 household member's records, submitted by the vendor to ensure compliance with the health and safety regulations. Emergency drill records and supplies were current. There were no medications on site.
Information gathered during the inspection determined areas of non-compliance with applicable regulations or law, and violations were documented on the violation notice issued to the vendor.

Standard #: 8VAC20-790-180-D
Description: Based on interview, records for children and caregivers were not accessible to the department's representative for review during an inspection.
Evidence:
1. On 8/15/22, the vendor was not at the family day home during the visit from 10:10 am to 10:40 am.
2. Household Member # 1 stated that she did not know where the records were kept. They were unavailable for review.

Plan of Correction: I will make sure that records are available in my absence.

Standard #: 8VAC20-790-250-D
Description: Based on staff interview and observation, caregivers present during the operating hours of the family day home, did not have cardiopulmonary (CPR) and first aid training.
Evidence"
1. on 8/15/22, Household Member # 1and Household Member # 2 were left in charge of the three children, and the vendor was not present.
2. On 8/23/22, the vendor stated that Household Member # 1 and Household Member # 2 did not have current First Aid and CPR training.

Plan of Correction: I will always make sure there is a first aid / cpr trained person on site.

Standard #: 8VAC20-790-250-F
Description: Based on staff interview, caregivers did not complete the department's health and safety update annual training.
Evidence: The vendor stated that she had not completed the department's annual Health and Safety Update training.

Plan of Correction: The training will be completed.

Standard #: 8VAC20-790-260-C-2
Description: Based on observation, electrical outlets did not have protective covers.
Evidence:
1. On 8/15/22, there were four outlet covers in the room where children were being cared for, that did not have protective covers.
2. On 8/23/22, two outlets by the windows and two outlets by the diaper changing table did not have covers.

Plan of Correction: Outlets will be covered.

Description: Based on observation and interviews, a caregiver was not physically present on site to provide direct care and supervision of each child.
Evidence:
1. On 8/15/22, the Licensing Inspector was informed by Household Member # 2 at 10:10 am that the vendor was not at home.
2. Household Member # 2 brought Household Member # 1, who stated that the vendor had taken some of the children for breakfast.
3. The Licensing Inspector was at the home till 10:40 am, and the vendor had not returned during that time.

Plan of Correction: The provider will make sure that if she needs to leave another caregiver is on site that is trained and qualified to take care of children.

Standard #: 8VAC20-790-320-B
Description: Based on observation and interview, infants spent more than 30 continuous minutes in a car seat during while awake.
Evidence:
1. on 8/15/22, the inspection started at 10:10 am, and the vendor was not present at the home during the inspection.
2. Household Member # 1 stated that she was not sure when the vendor left. She estimated that the vendor left approximately 15-30 minutes before the beginning of the inspection.
3. Child # 3 was observed strapped and seated in a car seat, watching cartoons.
4. Household Member # 1 asked Household Member # 2 if Child # 3 has been sitting in the car seat since the time the vendor left. Household Member # 2 said yes.
5. Child # 3 was removed from the car seat at approximately 10:35 am to change his diaper.

Plan of Correction: I will make sure that infants are not left in the car seat.

Standard #: 8VAC20-790-390-E
Description: Based on observation and staff interview, the diapering surface was absorbent.
Evidence:
1. On 8/15/22, Household Member # 1 was observed changing Child # 3's diaper. The diaper pad had a cloth cover on it. Additionally the diapering surface was not cleaned and sanitized after the diapering was completed.
2. On 8/23/22, the vendor was observed changing Child # 3's diaper. The diaper pad had the same cloth cover on top, and the surface was not cleaned and sanitized after diapering was complete.
3. The vendor stated that she only used a disinfectant to sanitize the diapering surface. She stated that did not use soap and water t clean the diaper pad after each use.

Plan of Correction: The cover will be removed. Soap and water will be added to the diapering procedures.
