63.2(17) License & Registration Procedures

Technical Assistance:
2020 legislative implementation discussed to include new out-of-state background check requirements.

Comments:
This inspection was conducted by licensing staff using an alternate remote protocol, necessary due to a state of emergency health pandemic declared by the Governor of Virginia.

A monitoring inspection was initiated on 08/12/2020 and concluded on 08/19/2020. The director was contacted by telephone to initiate the inspection. There were 126 children present and 12 staff. The inspector emailed the director a list of items required to complete the inspection. The inspector reviewed 4 children's records and 4 staff records submitted by the facility to ensure documentation was complete.

Information gathered during the inspection determined non-compliance with applicable standards and law and violations were documented on the violation notice issued to the facility.

The Licensing Inspector has reviewed with the director COVID-19 Essential Guidance for Child Care programs.

Violations:
Standard #: 22VAC40-185-90--A
Description: Based on record review, the center failed to ensure that the following statement is included in the written parent agreement that is required to be in each child's record before the first day of attendance:
*A statement that the parent will inform the center within 24 hours or the next business day after his child or any member of the immediate household has developed any reportable communicable disease, as defined by the State Board of Health, except for life threatening diseases which must be reported immediately.

Evidence:
1. The written communicable disease statement in the record of child 1, child 2, child 3 and child 4 is incomplete and does not include all required information.
a. The statement in the enrollment record reads as follows:
"I agree to inform the YMCA child care staff/director within 24 hours or the next business day by the State Board of Health, except for life threatening diseases which must be reported immediately."
2. The statement lacks the following required information:
"...after his child or any member of the immediate household has developed any reportable communicable disease...."

Plan of Correction: Enrollment forms will be updated to include the complete communicable disease statement as required by Standard 90.A.3

Standard #: 63.2(17)-1720.1-B-3
Description: Based on record review, the center failed to obtain an out of state child abuse and neglect search request by the end of 30th day of employment for staff.

Evidence:
1. The central registry check for staff 1, from the State of Georgia, was not obtained within 30 days of employment:
a. Staff 1 has a hire date of 06/12/2019 and indicated on her sworn statement or affirmation that she had resided in the State of Georgia within the past five years.
b. A central registry check was obtained, from the State of Georgia, on 08/18/2020.

Plan of Correction: All out-of-state background checks will be requested within the appropriate time frame going forward.
