8VAC20-790 Subsidy Program Vendor Requirements for Family Day Homes

Technical Assistance:
1. Any adult staying in the home for more than 30-days is required to have background checks completed. This includes any renters that pay for a room in the home.

Comments:
An unannounced subsidy health and safety inspection (SHSI) was conducted at 12:30pm. Observed 4 children totaling = 5 points with the vendor. Adult #4, a household child, and a visiting adult were also present in the home. Ratios and supervision were incompliance. The children were playing with toys, washing hands, eating lunch, and preparing to take naps. The daycare areas of the home were found to be clean and sufficiently supplied with toys and equipment for the children. Areas of non-compliance with subsidy requirements and laws reviewed were found. Questions about this inspection may be directed to pamela.sneed@doe.virginia.gov

Violations:
Standard #: 8VAC20-790-170-C
Description: Based on interview conducted and contact with a local agency, the vendor failed to ensure that an adult living in the home has completed required background checks. Evidence: The local agency reported not having completed background checks for Adult #1 to include: a criminal record check and central registry search.

Plan of Correction: The Office for Children will contact the vendor to get the background checks completed.

Standard #: 8VAC20-790-190-B
Description: Based on records reviewed, the vendor failed to ensure that 5 of 5 children's records included required documentation.

Evidence:

1. Child #3 - There was not an emergency medical authorization form and a decision to administer medication form signed by the parent on-file.
2. Child #7 - There was no documentation of the parents home and work address and phone numbers and no decision to administer medication form signed by the parent on-file.
3. Child #11 - There was no documentation of individuals authorized to pick up the child; the name, address and phone number of one emergency contact person, and no decision to administer medication form signed by the parent on-file.
4. Child #12 - There was no documentation of individuals authorized to pick up the child; the name, address and phone number of one emergency contact person; and no decision to administer medication form signed by the parent on-file.
5. Child #13 - There was no documentation of 1 of 2 parents home and work address and phone number; the name of individuals authorized to pick up the child, as the father was written in this section of the form; the name, address and phone number of one emergency contact person, as the father was written in this section of the form; and no decision to administer medication form signed by the parent on-file.

Plan of Correction: The vendor said she will make sure all child papers are completed by parents.

Standard #: 8VAC20-790-250-F
Description: Based on records reviewed, the vendor failed to ensure that the department's annual health and safety training course was completed in the last 12 months. Evidence: The class was last completed on 3/25/22.

Plan of Correction: The vendor said she will take the class if the inspector will send her the information.

Standard #: 8VAC20-790-260-A
Description: Based on observations made and interview conducted, the vendor failed to ensure that all areas of the home were maintained in a clean and safe condition, as she does not have access to one bedroom. Evidence: The bedroom belonging to Adult #1 was locked and inaccessible to the inspector. The vendor said Adult #1 changed the lock and did not give her a key. She said that she does not have access to Adult #1's bedroom.

Plan of Correction: The vendor said Adult #1 does not want her to have a key to his bedroom. The vendor will tell Adult #1 she must have a key to the bedroom.

Standard #: 8VAC20-790-270-A
Description: Based on observations made, the vendor failed to ensure that potentially poisonous substances were stored in an area not accessible to the children. Evidence: A spray bottle labeled "alcohol", a spray can of air freshener, and 2 containers of disinfecting household cleaning wipes were sitting on the kitchen counter/bar near where the children eat lunch. The products were within reach of the children.

Plan of Correction: The vendor moved the cleaning products out of reach of the children during the inspection.

Standard #: 8VAC20-790-280-A-4
Description: Based on observations made, the vendor failed to ensure that disposable paper towels were kept in the bathroom. Evidence: The provider said she keeps paper towels in the kitchen and will give them to the children if they don't want to use the cloth bath towel to dry their hands.

Plan of Correction: The vendor put paper towels in the bathroom during the inspection. She said children will use paper towels to dry their hands.

Standard #: 8VAC20-790-430-B
Description: Based on interview conducted, the vendor failed to ensure that monthly emergency drills were conducted and documented. Evidence: The vendor said she had not practiced and documented drills.

Plan of Correction: The vendor said she has the form to write down emergency drills and she will practice drills with the children every month.
