8VAC20-790 Subsidy Program Vendor Requirements for Family Day Homes

Comments:
An unannounced annual Unlicensed Subsidy Health and Safety (USHSI) inspection was conducted on 11/28/2023. There were no children present during the inspection and according to the vendor, children are not enrolled at this time. Vendor is will and prepared to receive children.
The inspector reviewed compliance in the areas of administration, physical plant, and emergencies. The Vendor's record, and 2 Household Members records were reviewed to ensure compliance with the health and safety regulations. The vendor completed a total of 20 training hours to comply with the requirement of 16 hours of annual training.
Information gathered during the inspection determined non-compliance with applicable standards or law and violations were documented on the violation notice issued to the program. Standard #: 8VAC20-790-170-C
Description: Based on record review and interview, the vendor did not ensure to obtain fingerprint-based criminal history check determination letter every five years for each household member.
Evidence:
1) The fingerprint-based criminal history check determination letters in the records for the Vendor and for Household Member #1 were each dated 08/15/2018.

Standard #: 8VAC20-790-200-3
Description: Based on record review, the vendor did not ensure to obtain and submit the results of a follow-up tuberculosis (Tb) screening at least every two years.
Evidence:
1) A current Tb screening was due for the Vendor. The most recent Tb screening submitted was dated 04/13/2021. The Vendor agreed to provide documentation of a current Tb screening, electronically within 24 hours, which was not provided.

Description: Based on the review of emergency supplies and interview with the vendor, it was determined that one working, battery-operated radio was not available.
Evidence:
1) On the date of inspection, a working, battery-operated radio was not available for review. 2) The vendor stated that it broke and they had not bought a new one.

Description: Based on documentation review and interview with the vendor, shelter-in-place procedures were not practiced a minimum of twice per year.

1) On the date of inspection, the emergency drills log provided for review, did not have shelter-in-place drills documented in the Nov 2022 - June 2023 period. 2) The provider stated that they did not conduct shelter-in-pace drills.
