22VAC40-191 Background Checks for Child Welfare Agencies 63.2(17) License & Registration Procedures

Technical Assistance:

Sworn statement or affirmations must be completed by the first day of employment. Fingerprint background checks are required before hire or the first day of service. Central registry background checks are required within 30 days of employment or service. Out of state central registry background checks are required to be requested within the first 30 days of hire for any staff person that indicates out of state (Virginia) residence in the past 5 years. All background checks, sworn statement, fingerprint background checks, central registry are required to be repeated every 5 years.

Comments:

An unannounced monitoring inspection was conducted beginning at 9:30 a.m. and ending at 12:30 p.m. with the director. There were 67 children in care, age 2.5 years old to 5 years old under the care and supervision of 12 staff. Children were observed during centers that included art, manipulatives, and sensory play. Center documents and 26 staff records were reviewed. Standard #:	22VAC40-191-40-D-2
Description:	Based on review of staff records and interview with staff, it was determined that the center did not obtain sworn statment or affirmation by the first day of employment and central registry background check results by the 30th day of employment for all staff as required. Evidence: Staff #10, hired 12/2018, central registry background check was dated 6/17/19. Staff #17, hired 1/2019, sworn statement was dated 5/29/19 and central registry background check was dated 10/3/19.
Plan of Correction:	In the future all background checks will be conducted within the required time frames.
Standard #:	63.2(17)-1716-A-6
Description:	Based on review of documentation and interview with staff, it was determined that the center did not provide a written statement to the parents or guardians of the center regarding physical facilities, health requirements for staff and public liability insurance disclosure. Evidence: The written statement regarding the center's physical facilities, health requirements for staff and public liability insurance was not provided to parents.
Plan of Correction:	The written statement will be provided to the parents or guardians of the children at the center.
Standard #:	63.2(17)-1716-B-3
Description:	Based on review of documentation and interview with staff, it was determined that the center did not have a person trained to perform a daily simple health screening and exclusion of sick children. Evidence: No staff were trained in Daily Health Observation training.
Plan of Correction:	Staff will be trained in Daily Health Observation training.
Standard #:	63.2(17)-1716-B-6
Description:	Based on review of documentation and interview with staff, it was determined that the center did not ensure that there was a procedure to ensre that all staff were able to recognize the signs of child abuse and neglect. Evidence: There was no procedure regarding recognizing child abuse and neglect.
Plan of Correction:	Staff will be trained and complete the online Virginia Department of Social Services training as oon as possible.
Standard #:	63.2(17)-1720.1-B-2
Description:	Based on review of staff records and interview with staff, it was determined that the center did not obtain national fingerprint background check results for all staff prior to employment. Evidence: Staff #10, hired December 2018, fingerprint background check was dated 6/5/2019. Staff #12, hired 2016, Staff #17, hired 1/2019, Staff #22, hired 2005, and Staff #25, hired 2004, did not have documentation of fingerprint background checks in the record.
Plan of Correction:	Staff #10 will be required to complete background check as soon as possible. The documentation for the missing background checks will be located and filed as soon as possible. The Office of Background investigation was contacted during the inspection for the missing documentation. In the future, all staff will have fingerprint background check results before starting.
Standard #:	63.2(17)-1720.1-B-3
Description:	Based on review of staff records and interview with staff, it was determined that the center did not request out of state central registry background checs for staff that resided outside of Virginia in the last five years. Evidence: 1. Staff #9, hired in 2017, indicated out of state residence in Kansas in the last five years and there was no documentation of an out of state central registry check request for Kansas. 2. Staff #15, hired in 2018, indicated out of state residence in New York in the last five years and there was no documentation of an out of state central registry check request for New York. 3. Staff #21, hired in 2018, indicated out of state residence in New Mexico in the last five years and there was no documentation of an out of state central registry check request for New Mexico.
Plan of Correction:	Out of state central registry background checks will be requested as soon as possible.
