The licensing inspectors conducted an unannounced complaint inspection on 10/24/2019 in response to a compliant that was received by the licensing office on 10/18/2019. An allegation was made that the center had an unsatisfactory background check.
Six staff's records were reviewed. The preponderance of evidence gathered during the inspection does not substantiate the allegation. A violation regarding background check requirements was found during the inspection and is identified on the violation notice. The center must send documentation to the licensing inspector that the background checks have been requested no later than 10 days following this notification dated 10/24/2019. Standard #: 22VAC40-191-40-D-2 Complaint related: No Description: Based on record reviews, the center failed to obtain background checks for new staff in the required time period.
Evidence:
1. The inspector reviewed six staff's records. All six staff's records did not contain a sworn statement or affirmation. Sworn statements are required before employment begins. Two of six staff's records reviewed (staff records #5 and #6) did not contain a search of the central registry. A search of the central registry is required within 30 days of employment. Staff #5's date of employment was 09/17/2019 and staff #6's date of employment was 09/13/2019.Plan of Correction: The director submitted copies of sworn statements for staff #1, staff #2, staff #3 and staff #6 to the licensing office on 10/28/2019. Staff #4 and staff #5 are no longer employed at the center. A copy of the results of the search of the central registry check for staff #6 will be submitted to the licensing office once it is obtained.
