63.2(17) License & Registration Procedures

Comments:
Violations have been cited related to information submitted by the provider of a report of an injury to a child while under the supervision of a center that requires outside medical treatment. Please see Violation Notice for more details.

Violations:
Standard #: 22VAC40-191-40-D-2
Description: Based on record review, in one of two staff records reviewed, the center did not ensure that all staff have results of a search of the Central Registry within 30 days of employment.

Evidence: During the inspection conducted on November 6, 2019, the documentation of results of a Central Registry finding for Staff #3 (date of hire 2/19/17) was not available for review and the Director confirmed that there was no documentation available.

Plan of Correction: Director called to get information regarding Employee #3 and they had the results but had sent them to the wrong email. Office of Background Investigations said that they had three to five business days to get the results to me. On November 12th, I had to call again and on November 13th I obtained the results.

Standard #: 63.2(17)-1716-B-2
Description: Based on staff interviews and inspection of the facility, the center did not implement established procedures regarding appropriate supervision of all children in care.

Evidence:

1. Staff #1 confirmed in an interview that on November 1, 2019, Child #1 was restless and disruptive during the designated rest period. Staff #1 verified that she "corrected" Child #1 a couple times and said "ok, let's wrap you". She then had the child to stand up with the child's arms straight down by her sides and wrapped the child in a blanket approximately 3'x5' so that it folded around the child's shoulders and torso twice. Staff #1 stated that Child #1 protested because "she didn't want to be wrapped". Staff #1 stated that "when [she] attempted to lay Child #1 face down, [she] lost her grip and the child slipped out of [her] hands. The child dropped to the rest mat that was on the tile floor and started to cry. Staff #1 noticed that the child "bit her lip" and she "didn't realize that she hit that hard".

2. Staff #1 stated that she took the child out of the room and asked the child "what was wrong, what happened? and Child #1 said "you scared me". Staff #1 then asked the child "did something else happen, I didn't mean to scare you" and the child said, "I hurt my lip". Staff #1 said that there was "a little cut on the inside". She stated that she was able to calm the child and after waking up Child #1 from nap, she noticed that "there was some slobber on her bed that looked like some residual gum bleeding".

3. The Center Director confirmed that naptime supervision procedures include the practice of "[wrapping children] if they want to be wrapped, especially if they ask". According to Staff #1 and Staff #2, Child #1 did not ask to be wrapped during naptime on November 1, 2019 and protested when wrapped.

Plan of Correction: We no longer wrap at all. If the child wants to be wrapped they have to wrap themselves the best they can. If problems persist with the child being disruptive during naptime then we call their parents to have them picked up for the duration of the naptime. Children are only given blankets from the center if they have not provided any of their own.
