22VAC40-191 Background Checks for Child Welfare Agencies

Comments:
This inspection was conducted by licensing staff using an alternate remote protocol, necessary due to a state of emergency health pandemic declared by the Governor of Virginia.

An unannounced code compliance inspection was initiated on 6/23/2021 and concluded on 6/24/2021. The person in-charge was contacted by telephone to initiate the inspection. There were 42 children present and 10 staff. The inspector emailed the provider a list of items required to complete the inspection. A virtual tour was taken of the facility. The Inspector reviewed 2 staff records submitted by the facility to ensure documentation was complete.

The Licensing Inspector has reviewed with the provider COVID-19 Essential Guidance for Child Care programs.
Information gathered during the inspection determined non-compliance with applicable standards or law and violations were documented on the violation notice issued to the facility.

Violations:
Standard #: 22VAC40-191-40-D-2
Description: Based on record review and interview, the center failed to have a completed central registry record check by the end of the 30th day of employment.

Evidence:

1. The record for staff 2 was reviewed. The start date was documented at 12/6/16. There was no central registry background in the record.
2. The director was unable to locate a completed central registry background check. At the time of the inspection the director did not have access to the church records and was unaware if the church had a copy.

Plan of Correction: The director will talk to the church administration to see if they have a copy of staff central registry background checks. If they do not a central registry background check will be completed for staff 2. In the future central registry background checks will be completed for all staff to be mailed upon hire.

Description: Based on record review and interview, the center failed to establish and implement a procedure to ensure that all staff are able to recognize the signs of child abuse and neglect.

Evidence:

1. The record for staff 1 was reviewed. There was no documentation for completing training in recognizing the signs of child abuse and neglect.
2. The director stated staff 1 completed training in sexual abuse but not recognizing the signs of child abuse and neglect.

Plan of Correction: Staff 1 will be signed up to complete training in recognizing the signs of child abuse and neglect on 7/1/21 when the training becomes available. In the future all new staff will be required to complete the training prior to working with children.
