22VAC40-191 Background Checks for Child Welfare Agencies

Comments:
This inspection was conducted by licensing staff using an alternate remote protocol, including telephone contacts, documentation review and a virtual tour of the program.

A code compliance inspection was initiated on 9/16/21 and concluded on 9/17/21. The director person was contacted by telephone and a virtual inspection was conducted. There were 16 children present, ranging in ages from three to four, with four staff supervising. The inspector reviewed compliance in the areas of administration, physical plant, staffing and supervision. A total of children?s records three and three staff records were reviewed.

Information gathered during the inspection determined non-compliance with applicable code sections and violations were documented on the violation notice issued to the program.

Violations:
Standard #: 22VAC40-191-40-D-2
Description: Based on record review and interview, the center failed to have a completed central registry record check by the end of the 30th day of employment.

Evidence:

1. Staff 1's date of hire per the director was 8/16/21. There is no completed central registry background check. The director stated she believes it was mailed some time before 9/3/21.
2. Staff 2's date of hire per the director was 6/1/21. There is no completed central registry background check. The director stated she believes it was mailed some time before 7/23/21.
3. Staff 3's date of hire per the director was 3/31/21. The central registry background check is dated 6/7/21.

Plan of Correction: 1. After contacting VDSS multiple times, we received info that payment for staff 1 was receive; however the requests will not appear until intake has completed by VDSS. We will forward this when we receive.
2. VDSS said they will not process staff 2's check without a middle name; however staff 2 does not have a legal name so this has been submitted and we are awaiting a response from VDSS.
3. Staff 3's central registry has been submitted.

Standard #: 63.2(17)-1716-A-4
Description: Based on record review and interview, the center failed to ensure all staff have been certified by a practicing physician or physician assistant to be free from any disability which would prevent him/her from caring for children under his/her supervision prior to start date.

Evidence:

1. Staff 1's date of hire per the director was 8/16/21. There is no documentation stating staff 1 is free from any disability which would prevent him/her from caring for children.
2. The director stated staff 1 does not have a primary care physician and due to COVID has been unable to find a doctor willing to complete the document.

Plan of Correction: Staff 1 will continue to try and have form completed. VDOH, MedExpress and local doctors will not complete the form at this time unless already a patient.

Standard #: 63.2(17)-1720.1-B-2
Description: Based on record review and interview, the center failed to obtain fingerprint-based criminal history check determination letters prior to the first day of employment.

Evidence:

1. Staff 1's date of hire per the director was 8/16/21. The fingerprint results are dated 9/17/21. The director stated staff 1 completed the fingerprints but the results took too long.
2. Staff 2's date of hire per the director was 6/1/21. There are no fingerprint results in the record. The director stated staff 2 is a high school student and cannot get to the location to get her fingerprints completed before they close.
3. Staff 3's date of hire per the director was 3/31/21. The fingerprint results are dated 9/14/21. The director stated staff 3's ID was expired and she does not drive. She had to wait for an appointment to got to DMV and for a ride.

Plan of Correction: 1. Staff 1's fingerprint results have been received and submitted.
2. Staff 2 has fingerprinting scheduled 9/20/21 and the results will be submitted as soon as received.
3. Staff 3's fingerprint results have been received and submitted.
