8VAC20-790 Subsidy Program Vendor Requirements for Child Day Centers

Technical Assistance:
New Emergency drill log reviewed.

Comments:
A subsidy health and safety inspection (SHSI) was completed on July 11, 2022 from 1:30pm to approximately 3pm. A Religiously Exempt Child Day Center Code Compliance inspection was conducted on the same date as the SHSI supplemental inspection; the two inspections combined cover all subsidy health and safety requirements. Only subsidy requirements that are not covered in code compliance were reviewed during this supplemental inspection. Information gathered during the inspection determined non-compliance(s) with applicable standards or law and violations were documented on the violation notice issued to the program. The violations are listed on the violation notice issued to the center and were reviewed with the site owner at the exit interview.

Violations:
Standard #: 8VAC20-790-560-A
Description: Based on record review and interview, it was determined that the vendor did not ensure that staff be evaluated by a health professional and be issued a statement that the individual is determined to be free of communicable tuberculosis (TB) within the last 30 calendar days of the date of employment.
Evidence:
1. Staff #2 (date of hire 9/07/21) had her TB screening completed on 12/07/21 which is three months after their hire date.
2. Staff #3 (date of hire 9/01/21) had her TB screening completed on 3/21/22 which is 6 months after their hire date.
3. Staff #1 confirmed that both Staff #2 and Staff #3 did not have their TB screening within the last 30 days of the date of employment.

Plan of Correction: The vendor responded with the following: Staff #1 will ensure that all new staff will have their TB screening in the appropriate time frame and prior to working with children.

Standard #: 8VAC20-790-630-A
Description: Based on observation and interview, it was determined that areas and equipment of the center be maintained in a safe and operable condition. Unsafe conditions shall include splintered, cracked or otherwise deteriorating wood; chipped or peeling paint; visible cracks, bending or warping, rusting, or breakage of any equipment; head entrapment hazards; protruding nails, bolts, or other components that entangle clothing or skin; and unstable heavy equipment, furniture, or other items that a child could pull down on himself.
Evidence:
1. In the 4 year old classroom, there is an area of peeling paint (approximately 4 feet long) to the bottom of the wall in reach of children. A child was napping less than one foot from the peeling paint area.
2. Staff #4 confirmed there was peeling paint in reach of children in care.

Plan of Correction: The vendor responded with the following: A work order will be put in to fix the peeling paint.
