Comments:
An unannounced code compliance inspection was initiated on 8/4/2022 and concluded on 8/4/2022 from 9:45 AM to 11:00 AM. The summer program was closed in preparations for school starting next week. The inspector reviewed compliance in the areas of administration, physical plant, staffing and supervision, procedures and medication. A total of four staff?s records were reviewed.
Information gathered during the inspection determined non-compliance with applicable standards or law and violations were documented on the violation notice issued to the facility. Once corrections have been completed they are to be forwarded to the licensing inspector.

Violations:
Standard #: 22.1-289.035-B-4
Description: Based on record review and interview, the center failed to obtain a search of child abuse and neglect registry or equivalent registry maintained by any other state in which a new staff has resided in the preceding five years for any founded complaint of child abuse or neglect against him/her prior to the first day of employment.

Evidence:

1. The sworn statement for staff 3 documents staff 3 resided in Hawaii within the last five years.
2. The start date for staff 3 was 2/1/22. The record did not contain documentation of a search of child abuse and neglect registry or equivalent registry from Hawaii.
3. The director verified a Hawaii search of child abuse and neglect registry or equivalent registry was not completed for staff 3.

Plan of Correction: A central registry (CPS) background check for Hawaii will be processed within 10 days and proof of completion will be provided to licensing. In the future staff that resided out side of VA within the last five years will have out of state CPS background checks completed prior to the first day of employment.

Standard #: 22.1-289.036-B-2
Description: Based on record review and interview, the center failed to obtain fingerprint-based criminal history check determination letters prior to the first day of employment.

Evidence:

1. The file for staff 1, hire date 11/17/21, contained a fingerprint-based criminal history check determination letters dated 12/21/21.
2. The director verified the dates.

Plan of Correction: In the future no staff will be hired until fingerprint results are received.

Standard #: 8VAC20-770-40-D-2
Description: Based on record review and interview, the center failed to have a completed central registry record check by the end of the 30th day of employment.

Evidence:

1. The record for staff 1, hire date 11/17/21, did not contain the results of a central registry background check.
2. The record for staff 2, hire date 8/23/21, did not contain the results of a central registry background check.
3. The record for staff 3, hire date 2/1/22, did not contain the results of a central registry background check.
4. The director verified the central registry background checks were not processed until 7/22. The results have not been received as of the date of the inspection.

Plan of Correction: The central registry (CPS) documents were mailed in July 2022. If the results are not received by 8/29/22 the office of background investigations will be contacted to follow up on the status. The results will be forwarded to licensing once received. In the future CPS documents will be mailed for processing upon hire.
