- Technical Assistance:
**Employees are prohibited from working in a position that involves direct contact with a person or child receiving services until a criminal record clearance has been received, unless that person works under the direct supervision of another employee for whom a background check has been completed. Direct supervision means that the employee will remain within sight and sound supervision of an employee with a completed background check.
An unannounced renewal inspection was conducted with provider's assistant. There were seven children present, ranging in age from 21 months to 6 years old, totalling 13 points. The children were playing outdoors in Little Tikes cars, playground equipment, and with chalk and bubbles. The children washed up for lunch; chicken nuggets, apples, macaroni and cheese, and milk. After lunch, it was time for rest. Six children's files and one staff file were reviewed - please see Supplemental Summary for missing items. Provider does not administer medication. Standard #: 22VAC40-111-90-A Description: Based on review of six children's files, the provider failed to have documentation that each child has been adequately immunized before the child attends the family day home. Evidence: Child D (date of enrollment 6/20/2016) and Child F (date of enrollment 6/20/2016) did not have documentation of immunization record before the first day of attendance. Plan of Correction: Provider will request the immunization record from the parents again as well as the physical (due within first 30 days of enrollment).
Standard #: 22VAC40-191-60-C-1 Description: Based on review of one staff record, the provider failed to have an original criminal history record report within 30 days of employment. Evidence: Staff A (date of hire 3/29/2016) did not have documentation of a completed criminal history record report. Plan of Correction: The provider mailed the criminal history record report within 7 days of hire, but it has not been returned. There was no documentation that the provider contacted Virginia State Police to check the status of the report within 30 days of employment. Staff A will not return to work until the criminal history record check is returned with satisfactory findings.
Standard #: 63.2-1720-F Description: Based on review of staff records, the provider failed to provide direct supervision of an employee who did not have a completed criminal history record check. Evidence: Staff A (date of hire 3/29/2016) did not have documentation of a completed criminal history record. Staff A was alone with the children during today's inspection. Plan of Correction: The criminal history record was submitted to Virginia State Police within 7 days of hire, but has not been returned. Provider will call to check on the background check; Staff A will not return to work until criminal history record is returned with satisfactory findings.
