Comments:

A code compliance inspection was initiated and concluded on 4-13-2023. There were 32 children present with 6 staff supervising. The inspector reviewed compliance in background checks and requirements for child day centers operated by religious institution exempt from licensure. A total of 5 staff records were reviewed. Information gathered during the inspection determined non-compliance(s) with applicable code sections and violations were documented on the violation notice issued to the program.

Violations:

Standard #:	22.1-289.031-B-1
Description:	Based on observation and staff interview the center did not establish and implement procedures for hand washing by children after toileting/diapering. Evidence: Staff was observed changing a child?s pull up. The staff member and child did not wash their hands after the pull up was changed.
Plan of Correction:	Staff were retrained same day regarding handwashing requirements. New postings were displayed to serve as reminders. Observations were conducted by director to ensure implementation.
Standard #:	22.1-289.035-B-2
Description:	Based on record review and interview with staff, the center did not ensure to obtain a fingerprint based national criminal record check prior to the first day of employment for each staff. Evidence: The Director confirmed that the record for staff #3 did not contain documentation of a fingerprint check prior to the first day of employment.
Plan of Correction:	Employee was temporarily relieved of duties following inspection until Background results were obtained. New checks were submitted right away and has since been obtained.
Standard #:	22.1-289.035-B-4
Description:	Based on record review and staff interview the center did not ensure to obtain a copy of the results of a criminal history record information check, a sex offender registry check, and a search of the child abuse and neglect registry or equivalent registry from any state in which the individual has resided in the preceding five years. Evidence: Staff # 4 indicated on the sworn statement as to having lived outside of the state of Virginia within the last five years. The staff person in charge confirmed that the center had not obtained all required out of state background checks. 1. There was no documentation of an out of state (Louisiana) criminal record check and an out of state child abuse and neglect search in the record for Staff #4
Plan of Correction:	Out of state background check was submitted immediately and cleared results were obtained the next day.
Standard #:	8VAC20-770-40-D-2
Description:	Based on record review and staff interview, the center did not ensure that a prospective employee, volunteer, or any other person who is expected to be alone with one or more children enrolled in the religious exempt child day center shall undergo a search of central registry, within 30 days of employment or commencement of service. Evidence: The Director confirmed that the record for Staff #3 did not have documentation of a search of the central registry.
Plan of Correction:	Employee was temporarily relieved of duties following inspection until background results were obtained. New checks were submitted right away and has since been obtained.
