8VAC20-790 Subsidy Program Vendor Requirements for Child Day Centers

Comments:
A Subsidy Health and Safety inspection was conducted on 02/14/2024 to review health and safety requirements. At the time of inspectors' arrival there were 25 infant to preschool aged children in care with 4 staff members and 1 administrator. Children were observed interacting with staff, nap, lunch and hand washing. A sample of 5 children's records and 5 staff records were reviewed. Director reported that there have been no injuries and medications are not being administered at this time. Areas of noncompliance are identified on the violation notice and were discussed with the director in an exit meeting at the conclusion of this inspection.

Violations:
Standard #: 8VAC20-790-540-B-12
Description: Based on record review and interview it was determined the center did not ensure each child's record contained proof of their identity and age as stated in ? 22.1-289.049 of the Code of Virginia.
Evidence:
1. There was no proof of identity and age in the record for child #2 and child #5.
2. Director confirmed this documentation was not present during this inspection.

Plan of Correction: All birth certificate were obtained and files updated.

Standard #: 8VAC20-790-640-A
Description: Based on observation and interview it was determined the center did not ensure that all hazardous substances were kept in locked place that prevents access by children.
Evidence:
1. There were Clorox wipes, diaper creams, ointments, and air fresheners unlocked on the shelves underneath the changing tables in the restrooms at child height.
2. Children were observed in the restrooms during this inspection.

Plan of Correction: All items were removed and placed in a sealed container away from kids line of sight. Kids were in the bathroom with a teacher because it was potty and diaper changing time after lunch.

Standard #: 8VAC20-790-730-A
Description: Based on observation it was determined the center did not ensure that all furnishings and equipment was age and stage appropriate for the children.
Evidence:
1. Inspector observed child #1(age 2) standing in a crib with the mattress at the highest setting and the top bar of the crib railing at the child's waist level, presenting a potential fall hazard.
2. Inspector spoke to the staff about this concern and they moved child #1 out of the crib and placed child #2 (age 23 months) into the crib.
3. Child #2 was then observed jumping in the crib with the top bar of the crib railing at the child's waist level, presenting a potential fall hazard.
4. Child #2 was removed from crib when inspector spoke to staff about the crib not being appropriate for child #2.

Plan of Correction: Upon notification staff was advised to placed only age appropriate toddler in the cribs. The crib was lowered to prevent any potential hazard.

Standard #: 8VAC20-790-820-B
Description: Based on observation and interview it was determined the center did not ensure that when children were placed in a high chair that the protective belt was fastened securely.
Evidence:
1. Children were observed seated in high chairs upon inspectors arrival. 2 of the children in the high chairs were not securely fastened.
2. The Director confirmed two of the children were not securely fastened in their highchairs.

Plan of Correction: Immediately upon the notification the staff was advised to make sure the kids were secure in the high chairs.
