Comments:
A monitoring inspection was initiated on 3/21/2024 and concluded on 3/21/2024. There were 16 children present with six staff supervising. The inspector reviewed compliance in the areas of administration, physical plant, staffing and supervision, programming, medication, special care and emergencies and nutrition. A total of three child records and eight staff records were reviewed. The inspection started at 11:35 am and concluded at 1:07 pm.

Information gathered during the inspection determined non-compliance with applicable standards or law and violations were documented on the violation notice issued to the program.

Violations:
Standard #: 22.1-289.035-B-2
Description: (REPEAT VIOLATION)
Based on record review the center failed to ensure that all staff submit to a fingerprint-based criminal history check prior to first day of employment.
Evidence:
Staff #1 & 3 do not have a fingerprint-based criminal history check on file. Both staff were present during the inspection.

Plan of Correction: The director will ensure that all staff have the required background checks within the time frames.

Standard #: 22.1-289.035-B-4
Description: (REPEAT VIOLATION)
Based on record reviews the center failed to ensure that staff who have lived out of the state of Virginia in the past five years have submitted to a criminal record check & sex offender check before the first day of employment and child abuse & neglect (CPS) check requested within 30 days of employment and followed up on within 45 days of request.
Evidence:
Staff #1 has lived outside of the state of Virginia in the past five years however, there are no out of state background checks on file.

Plan of Correction: The director will ensure that all staff have fingerprint-based criminal history check prior to the first day of employment.

Standard #: 8VAC20-770-40-D-2
Description: (REPEAT VIOLATION)
Based on record review and interviews the center failed to ensure that background checks are required after receipt of the initial religious exemption status letter. Annually, prior to the expiration date in the current exemption letter, the religious exempt child day center must file with the department documentary evidence that the center is in compliance with the following: WHO: Prospective employee, volunteer, or any other person who is expected to be alone with one or more children enrolled in the religious exempt child day center except a parent-volunteer, or a parent or guardian who may be left alone with his or her own child WHAT: Sworn statement or affirmation WHEN: Before employment or commencement of service at the facility WHAT:Search of central registry and criminal history record check, as requested by the individual WHEN: Within 30 days of employment or commencement of service.
Evidence:
1. Staff # 5 & 6 do not have a signed sworn statement on file prior to the first day of employment.
2. Staff #2 does not have a central registry record check by the end of the 30th day of employment.

Plan of Correction: The director will ensure that all staff have a signed sworn statement and central registry on file within the set time frames.
