An unannounced code compliance inspection was conducted on 04/17/2024 from 10:55 AM to 12:15 PM. There were 34 children present, ranging in ages from 2 years to five years, with eight staff. The inspector reviewed compliance in the areas of administration, physical plant, staffing and supervision, and procedures. A total of five children?s records and five staff?s records were reviewed.
Information gathered during the inspection determined non-compliance with applicable standards or law and violations were documented on the violation notice issued to the facility.

Standard #: 22.1-289.031-B-5 Description: Based on a review of the staff handbook and interview, the center failed to implement a procedure to ensure that all areas of the premises accessible to children are free of obvious injury hazards, including providing and maintaining cushioning material under playground equipment.
Evidence:
The cushioning material under the swings was not maintained resulting in a lack of cushioning material under the swings.Plan of Correction: The cushioning material will be raked to fill in the spots under the swings. In the future the director will ensure the procedures of maintaining the playground are followed.
Standard #: 22.1-289.035-B-4 Description: Based on record review and interview, the center failed to request a search of central registry background check within the first 30 days of employment and a search of sex offender registry prior to the first day of employment for any state in which a staff member resided in the preceding five years.
Evidence:
The record for staff 4 documents the first date of employment as 2/29/24. The sworn statement for staff 4 documents staff 4 lived in another state within the last five years. The is no documentation in the file of a search of central registry or sex offender registry for the other state.Plan of Correction: The out-of-state central registry search and sex offender search will be requested from the other state. Once they are complete the results will be forwarded to the licensing inspector.
Standard #: 8VAC20-770-40-D-2 Description: Based on record review and interview, the center failed to have staff sign a sworn disclosure statement prior to the first day of employment and have a completed central registry record check by the end of the 30th day of employment.
Evidence:
The record for staff 5 documents the first day of employment as 1/23/24. The central registry background check is dated 3/20/24.Plan of Correction: In the future the director and administrator will ensure the central registry background check request is completed within seven days of employment and followed-up within 30 days if the results are not received. The file will be documented with each step.
