Technical Assistance:
HB1823 adds ? 22.1-289.058 to the Code of Virginia. This bill requires all licensed child day programs and religiously exempt child day centers, certified preschools, family day system homes and certain other programs that serve preschool-age children operating in a building built before 2015 to be equipped with at least one carbon monoxide detector.

Comments:
This inspection was conducted by licensing staff using an alternate remote protocol, including telephone contact, document review, an interview with the provider and a virtual tour of the program.

A monitoring inspection was initiated on 9/8/2021 and concluded on 9/9/2021 with an exit interview. The provider was contacted by telephone and a virtual inspection was conducted. There were nine children present, ranging from 19 months to four years of age, with the provider and an assistant supervising. The inspector reviewed compliance in the areas of administration, personnel, physical health of caregivers, caregiver training, physical environment and equipment, care of children, preventing the spread of disease, medication, emergencies and nutrition. A total of two child records and two caregiver member records were reviewed.

The information gathered during the inspection determined non-compliance with applicable standards or law and violations are documented on the violation notice issued to the program. Violations:
Standard #: 22VAC40-111-120-A
Description: Based on review of documentation, and an interview with the provider, not all caregivers had a record as required. Evidence: there was no record for caregiver #2 (date of employment: 4/2021) with the caregiver's name, address, verification of age, job title, date of employment, name, address and phone number of a person to be notified in an emergency, documentation of orientation training, or documentation that two or more references as to character and reputation as well as competency were checked before employment.

Plan of Correction: Provider stated she will create a record and obtain the missing information.

Standard #: 22VAC40-191-60-B
Description: Based on review of two caregiver records, and an interview with the provider, it was determined that not all caregivers had a sworn statement completed prior to their first day of employment. Evidence: The record for caregiver #2 (Date of hire: 4/2021), did not have documentation of a sworn statement.

Plan of Correction: Provider stated the employee will not work again until they submit a signed sworn statement.

Standard #: 63.2-1720.1-B-2
Description: Based on review of two caregiver records, and an interview with the provider, it was determined that not all caregivers had an Office of Background Investigations (OBI) fingerprinting-based criminal history record check prior to their first day of employment. Evidence: the record for caregiver #2 (Date of hire: 4/2021), did not have an OBI determination letter.

Plan of Correction: Provider stated the employee will not work again until an OBI fingerprint determination letter is received.
