Comments:
An unannounced renewal inspection was conducted on 12/13/2021. There were 9 children, ages 19 months-3 years totaling 20 points, and 2 caregivers present during the inspection. The inspector observed the following: outside play, inside free activities and lunch. The inspector reviewed 5 children?s records, 3 caregiver records, 1 household member record and 1 pet record. The inspector discussed the following with the provider: documents that are required to be posted, annual training and storing household items properly. Information gathered during the inspection determined non-compliance with applicable standards or law and violations are documented on the violation notice issued to the provider. Standard #: 22.1-289.036-A
Description: Based on record review, the provider failed to ensure that every applicant and adult living in a family day home shall undergo all background checks in accordance with the Code of Virginia prior to issuance of a license and every five years thereafter.

Evidence:
1. The most recent sworn statement in the record for Caregiver 1 was dated 07/07/2016; there was not a sworn statement update in 2021 available for review during the 12/13/2021 inspection.
2. The most recent sworn statement in the record for Household Member 1 was dated 07/07/2016; there was not a sworn statement update in 2021 available for review during the 12/13/2021 inspection.

Standard #: 8VAC20-800-770
Description: Based on observation and discussion, the provider failed to ensure that a working portable battery-operated weather band radio shall be kept in a designated area and be available to caregivers at all times.

Evidence: There was not a working portable battery-operated weather band radio available during the inspection.

Plan of Correction: Will buy a radio.

Description: Based on document review and discussion, the provider failed to ensure that the emergency plan is reviewed at least annually, the provider shall document in writing each review and update to the plan.

Evidence: The most recent review/update to the plan was on 04/06/2020.

Plan of Correction: Will update today.

Standard #: 8VAC20-800-120-B
Description: Based on record review and discussion, the provider failed to ensure that each caregiver record contains all of the elements as required by the standards.

Evidence:
1. The record for Caregiver 2 did not contain verification of age, documentation that two or more references as to character and reputation as well as competency were checked before employment (there was only 1 reference in the record); and documentation of tuberculosis screening as required by 8VAC20-800-180.
2. The record for Caregiver 3 did not contain verification of age.

Description: Based on record review and discussion, the provider failed to ensure that each child?s record contains all of the elements as required by the standards.

Evidence:
1. The record for Child 1 did not contain the information on allergies and intolerance to food, medication, or any other substances, and actions to take in an emergency; and the names and addresses of previously attended child day care and schools.
2. The record for Child 2 did not contain the names and addresses of previously attended child day care and schools.
3. The record for Child 3 did not contain the names and addresses of previously attended child day care and schools.
4. The record for Child 4 did not contain the names and addresses of previously attended child day care and schools.
5. The record for Child 5 did not contain the name, address and telephone of two designated persons to contact in case of an emergency if the parent cannot be reached (the address for the second designated person was incomplete); the names and addresses of previously attended child day care and schools; immunization records for the child as required by 8VAC20-800-90; and results of the health examination for the child as required by 8VAC20-800-100.

Standard #: 8VAC20-800-520-A
Description: Based on observation and record review, the provider failed to ensure that cribs shall be provided for children from birth to 12 months of age.

Evidence: Child 2 was observed sleeping in a crib during the 12/13/2021 inspection. The documented birthdate in the record for Child 2 determined that Child 2 was 19 months old.

Plan of Correction: Will have the child sleep on a cot.
