Comments:
An unannounced renewal inspection was conducted on 05/19/2022. There were 3 children, ages 9 months- 2 years, totaling 10 points, one care giver and one household member present during the inspection. The inspector reviewed compliance in the areas of administration, personnel, environment and equipment, care of children, preventing the spread of disease, emergencies and nutrition. A total of 5 children?s records, 1 caregiver record, and 1 household member record were reviewed. The children were observed in free choice play. The inspector discussed the following: pets, nutrition and infant care. The inspector arrived for the inspection at 9:20 am and departed the family day home at 11:30 am.

Information gathered during the inspection determined non-compliance with applicable standards or law and violations were documented on the violation notice issued to the provider.

Violations:
Standard #: 22.1-289.036-A
Description: Based on record review, the provider failed to ensure that every adult living in a family day home shall undergo all background checks in accordance with the Code of Virginia prior to the issuance of a license and every five years thereafter.

Evidence:
1. The most recent findings from a search of the central registry for Caregiver 1 was dated 04/12/2016; there was not a 2021 follow-up search available for review during the inspection.
2. The most recent findings from a search of the central registry for Household Member 1 was dated 04/12/2016; there was not a 2021 follow-up search available for review during the inspection.

Plan of Correction: Have requested but will follow up.

Standard #: 8VAC20-800-730-D
Description: Based on observations and discussion, the provider failed to ensure that medications, except for those prescriptions designated otherwise by a written physician?s order, including refrigerated medication and medications for caregivers and household members, shall be kept in a locked place using a safe locking method that prevents access by children.

Evidence: There was a white oval pill in a bowl on the provider?s dining room table that was accessible to children. The provider stated that it was her pain pill that she had not taken that morning.

Plan of Correction: Will keeps medicines locked.

Description: Based on record review and discussion, the provider failed to ensure that the child?s record shall contain all of the elements as required by the standard.

Evidence:
1. The record for Child 1 did not contain the following: immunization records for the child as required by the standards.
2. The record for Child 2 did not contain the following: name, address and telephone number of two designated persons to contact in case of an emergency if the parent cannot be reached (contact 1 was a parent); immunization records for the child as required by the standards; and results of the health examination for the child as required by the standard.
3. The record for Child 3 did not contain the following: name, address and telephone number of two designated persons to contact in case of an emergency if the parent cannot be reached (contact 1 was a parent); immunization records for the child as required by the standards; and results of the health examination for the child as required by the standard.
4. The record for Child 4 did not contain the following: name, address and telephone number of two designated persons to contact in case of an emergency if the parent cannot be reached (contact 1 was a parent); immunization records for the child as required by the standards; and results of the health examination for the child as required by the standard.
5. Standard #: 8VAC20-800-260-A
Description: Based on observation and discussion, the provider failed to ensure that access to the water in aboveground swimming pools shall be prevented by locking and securing the ladder in place or storing the ladder in a place inaccessible to children.

Evidence: There was an aboveground pool on the property. The ladder was in the pool. There was approximately 6 inches of water in the pool.

Plan of Correction: Will remove the ladder.

Standard #: 8VAC20-800-280
Description: Based on observation and discussion, the provider failed to ensure that potentially poisonous substances were stored in areas inaccessible to children.

Evidence:
1. There was an opened can of interior wall paint on a table in the living room of the home. The paint was accessible to children.
2. The bathtub in the bathroom used by children was full of cans of interior wall paint. The paint was accessible to children.
3. There was an aerosol can of 409 in the dining room of the home. The 409 was accessible to children.
4. There were 2 spray bottles of fabric freshener under the fish tank. The fabric freshener was accessible to children.

Plan of Correction: Will take them out or put them away.

Standard #: 8VAC20-800-320-B
Description: Based on observation and discussion, the provider failed to ensure that child-resistant protective covers shall be installed on all unused electrical outlets and surge protectors accessible to children under five years of age.

Evidence:
1. There were 2 uncovered, unused electrical outlets in the living/dining room area of the home.
2. There was a surge protector by the fish tank. There were several uncovered, unused outlets on the surge protector that were accessible to children.
3. All of the children in care were under five years of age.

Plan of Correction: Will cover the outlets.
