Comments:
An investigation was initiated on 12/13/22 in response to a self reported incident regarding an injury to a child. The investigation was conducted jointly with the local agency. An on-site inspection and provider interview was conducted at the family day home on 1/12/23. Additional caregiver interviews were conducted on 2/9/23. Documentation and records related to the incident were also reviewed. Based on information gathered during the investigation, there was insufficient evidence to make a determination of valid; however, violations not related to the self-reported incident were found during the investigation. Violations are cited on the violation notice and were discussed with the provider at the conclusion of the investigation.

Violations:
Standard #: 8VAC20-770-60-C-2
Description: Based on record review and interview, the provider did not ensure that a central registry finding is obtained within 30 days of employment.

Evidence:
1. The records for caregiver 1 and caregiver 2 do not contain documentation of a central registry finding.
2. The provider confirmed that caregiver 1 and caregiver 2 began employment sometime in August 2022 and that the results of the central registry search for caregiver 1 and caregiver 2 have not been obtained.

Plan of Correction: The provider responded with the following: Caregiver 2 is no longer employed at the family day home. The central registry search for caregiver 1 will be completed and sent off. Once received, the results will be placed in the caregiver record. Going forward, the provider will ensure central registry searches are completed within the required timeframe.

Standard #: 8VAC20-800-100-A
Description: Based on record review and interview, the provider did not ensure that documentation of a physical examination by or under the direction of a physician is obtained prior to the child's attendance or within 30 days after the first day of attendance.

Evidence:
1. The record for child 1 (date of enrollment: 6/25/22) does not contain documentation of a physical examination.
2. The provider confirmed that the record for child 1 is lacking documentation of a physical examination.

Plan of Correction: The provider responded with the following: Child 1 is no longer enrolled in the family day home. Going forward, the provider will ensure children's physicals are obtained and placed in the record within the required timeframe.

Standard #: 8VAC20-800-120-B
Description: Based on record review and interview, the provider did not ensure that assistant's records contain all the required information.

Evidence:
1. The record for caregiver 1 does not contain her verification of age, date of employment or documentation that two or more references as to character and reputation as well as competency were checked before employment.
2. The record for caregiver 2 does not contain her verification of age, date of employment or documentation that two or more references as to character and reputation as well as competency were checked before employment.
3. The provider confirmed that the records for caregiver 1 and caregiver 2 are lacking the above information.

Plan of Correction: The provider responded with the following: Caregiver 2 is no longer employed at the family day home. References for caregiver 1 were contacted; however, the provider did not document them in the record. The date of employment, verification of age and reference checks for caregiver 1 will be obtained and placed in the record. Going forward, the provider will ensure caregiver records contain all the required information.

Standard #: 8VAC20-800-170-A
Description: Based on record review and interview, the provider did not ensure that a current Report of Tuberculosis Screening form published by the Virginia Department of Health or a form consistent with it documenting the absence of tuberculosis in a communicable form if obtained from each caregiver at the time of hire.

Evidence:
1. The provider stated caregiver 2 began employment in August 2022. The record for caregiver 2 contains a negative tuberculosis screening dated 11/10/21.
2. The provider confirmed that documentation of a negative tuberculosis screening was obtained from caregiver 2 after she began employment at the family day home.

Plan of Correction: The provider responded with the following: Caregiver 2 is no longer employed at the family day home. Going forward, the provider will ensure tuberculosis screenings are obtained at the time of hire.

Standard #: 8VAC20-800-200-C
Description: Based on record review and interview, the provider did not ensure that documentation of assistant orientation is signed and dated by the provider and assistant.

Evidence:
1. The records for caregiver 1 and caregiver 2 do not contain documentation of orientation that is signed by the provider and assistant.
2. The provider confirmed that the records for caregiver 1 and caregiver 2 are lacking documentation of orientation.

Plan of Correction: The provider responded with the following: Both caregiver 1 and caregiver 2 received orientation when they were hired; however, documentation of orientation was not completed. Going forward, the provider will ensure that documentation of orientation is signed by the provider and assistant and placed in the caregiver record.
