Description: Based on record review and interview, the provider did not ensure compliance with the home's termination of care policy that has been disclosed to the parents as required by 8VAC20-800-70.

Evidence:
1. The family day home's termination of care policy states: "Parent and daycare provider both agree to provide a 2-week written notice to terminate the daycare contract. Parent knows and agrees that if a 2 week written notice is not given to Provider prior to withdrawal of your child from daycare that fees will continue to be owed until a two week written notice is received. Fees for the two weeks are still due whether you child attends or not. *Provider has the right to terminate this contract instantly if you are your child has caused intentional harm to the other children (such as biting, hitting and kicking, etc) or is purposely destroying my home and not following the rules such as breaking things on purpose, swearing, and not listening to me."

2. On 2/23/2023, the family day home terminated the childcare services for child #1 and child #2.

3. On 2/23/2023, the provider notified the parent of child #1 and child #2 that their childcare service was ending on 2/23/2023.

4. The provider confirmed that the two-week notice was not provided to the parent, as required by the family day home's termination of care policy.

Plan of Correction: I will make sure I go by contract. Contract has been updated.
