Technical assistance: The importance of following the terms of the license was discussed with the provider. The provider was advised to contact Licensing if in doubt of unanticipated situations.

Comments:
An unannounced complaint inspection was initiated on 5/8/23. The complaint was related to the care of children being provided at a location other than the licensed family day home. 2 caregivers and one family member was interviewed. 1 child's record and attendance records were reviewed. Based on the preponderance of evidence, the complaint was deemed valid. Violations related and non-related to the complaint have been listed on the violation notice issued. Standard #: 8VAC20-800-30-A
Complaint related: Yes
Description: Based on staff interview, the provider did not ensure compliance with these standards and the terms of the current license issued by the department.
Evidence:
1. During the week of 4/24/23, the family day home was closed and care for Child # 1 was provided at another residence.
2. The provider stated that due to some home repairs she had to go live at another family member's house close to the family day home.
3. The provider stated that she cared for Child # 1 at the other home for most of the week, from 7:15 am to 6:00pm. The provider also stated that care provided on the main level of the home, primarily in the family room.

Plan of Correction: Will contact licensing department in doubt of unanticipated situations.

Description: Based on record review, the family day home did not keep a written record of children in attendance each day.
Evidence: Written attendance was not kept at the family day home from 4/24/23 through 4/28/23.

Plan of Correction: Keep a written record of children in attendance at all times.

Standard #: 8VAC20-800-150-C
Complaint related: No
Description: Based on staff interview and observation, an assistant was left alone with a child for over 2 hours per day.
Evidence:
1. On 5/8/23, the inspection started at 12:15 pm. The provider was not at the family day home when the inspection began.
2. Caregiver # 1 was supervising and caring for Child # 1.
3. Caregiver # 1 stated that the provider had left at 10 am.
4. Caregiver # 1 called the provider to inform her of the inspection and said that the provider was returning to the family day home.
5. The provider returned to the family day home between approximately 12:30pm to 12:40pm.

Plan of Correction: An assistant will not be left alone with a child for more than two hours per day. If needed, a substitute provider will be caring for child/children.
