1. Please review standard 580A and B.( Determining Need For Additional Caregivers).
One caregiver shall not exceed 16 points.
Children between the ages of 0-15 months is 4 points;
Children between the ages of 16 to 23 months is 3 points;
Children between the ages of 2 to 4 years is 2 points;
Children between the ages of 5 years to 9 years is 1 point;
Children who are 10 years of age and older count as 0 points.
2. A caregiver's own children and resident children under 8 years of age count in points maximum.
3. Your license capacity is 12 children, this capacity does not include resident children, today you had 14 children enrolled which exceeded your license capacity.
4. For all children, including large sibling groups, you need to write out each child's name on the attendance log.

An unannounced focused inspection was conducted with the assistant. At the conclusion of the inspection the provider arrived and further discussion and guidance was given to the provider.
Seventeen children, between the ages of 2 to 9 years were present with one caregiver for a total of 28 points. Three of the seventeen children present resides in the home. Two of the children had arrived at the time of the inspection were provided cereal and milk for breakfast while the other fifteen children were in the living room waiting to watch television.

Standard #: 8VAC20-800-30-A Description: Based on observation and interview, it was determined that the provider did not ensure compliance with these standards and the terms of the current license issued by the department .
Evidence:
Upon arrival, the Licensing Inspector observed 17 children with one caregiver. Interview revealed that 3 of the 17 children resides in the home, therefore the remaining 14 children were enrolled in the family day home.
